Petitioner had assailed the order of Single Judge 'of High Court ordering sale of 16 buses being plied under the supervision of official assignee of the High Court
Contention of petitioner was that Single Judge was not justified in observing that seating capacity of said 16 buses was 100 passengers, per bus while buses had seating capacity of 48 passengers only
Consolidated issues had been framed and matter was ripe for the evidence and it could be expeditiously adjudicated after the evidence of the parties was recorded
Notice was issued to the respondents and in the meantime, operation of the impugned order was suspended.

2. Learned counsel undertakes to comply the office objections before the next date.
3. Granted subject to above and all just exceptions. 4/5. It is submitted by the learned counsel that through the impugned order the learned Single Judge in Chamber has ordered for sale of 16 buses being plied under the supervision of the Official Assignee of this Court. It is urged that the learned Single Judge has erred in observing that the seating capacity of the said 16 buses is 100 passengers as according to the learned counsel the buses are having seating capacity of 48 passengers only. It is stated that consolidated issues have been framed and the matter is ripe for the evidence and, it can be expeditiously adjudicated after the evidence of the parties are recorded at Katcha Peshi Stage. Notice be issued to respondents. In the meantime, operation of the impugned order is suspended. H.B.T./M-15/K Order accordingly.
