Art. 58(3)-Joint petition by several accused-Special leave to appeal granted in respect of one accused only. Nemo for the State.

Judgment & Decree

CORNELIUS, C. J.- It is urged by learned counsel that the evidence in the case, when properly examined and evaluated, proves no more than the presence of Muhammad Khan petitioner, in the vicinity of the spot where the other three petitioners are said to have attacked and injured the witnesses Qalandar (the principal enemy) and Phula Khan. Muhammad Khan is only distantly related to the other three, who are brothers, and his connection with the earlier incidents which furnish the motive is correspondingly remote. We grant leave to examine whether, on the evidence Muhammad Khan can be held guilty of the offences found against the other three petitioners. He will be released on bail to the satisfaction of the District Magistrate, pending disposal of the appeal. As to the latter, the evidence is complete, and has been accepted after proper scrutiny by the Courts below. We accordingly dismiss the petition, in respect of Muhammad Bakhsh, Khuda Bakhsh and Ramzan petitioners. Petition partly accepted,
