Appeal against order of Social Security Court
Counsel of parties requested for setting aside impugned orders and for remitting the case to the Commissioner, Social Security Institution for rehearing appellant's complaint
Impugned orders were set aside and matter was remanded to the Commissioner, Social Security Institution for re-deciding the complaint in accordance with law with direction that all the questions of law and facts raised by the parties would be duly considered and the reasons to meet the same would be given in the ultimate order to be passed by the Commissioner.
Judgment & Decree
MUHAMMAD SAIR ALI, J.
Through this appeal, order dated 26-8-1999 passed by the Commissioner Punjab Employees Social Security Institution, Lahore on the appellant's complaint and order dated 28-2-2004 of the learned Judge Social Security Court, Punjab, Lahore dismissing the appellant's appeal thereagainst, have been called in question.
2. After arguments, the learned counsel for the respondents joins the appellant in the request for setting aside the above-said orders and for remitting the case to the Commissioner Punjab Employees Social Security Institution, Lahore for rehearing the appellant's complaint.
3. In view of the above joint request, this appeal is accepted. The impugned order dated 26-8-1999 and 28-2-2004 respectively passed by the Commissioner Punjab Employees Social Security Institution, Lahore and the learned Judge Social Security Court, Punjab, Lahore are set aside. The matter is remanded to the Commissioner Punjab Employees Social Security Institution, Lahore for re-deciding the complaint of the appellant strictly in accordance with the law. It is further directed that all the questions of law and facts raised by the parties shall be duly considered and the reasons to meet the same shall be given in the ultimate order to be passed by the Commissioner. Against an adverse order by the Commissioner, the appellant shall of course have the right to file his appeal to resort to the remedies allowed to the appellant under the law.
4. This appeal is decided as above with no order as to the costs. H.B.T./K-15/L Order accordingly.
