Imposition of
Civil servant who was Foodgrains Inspector, was imposed penalty of recovery of amount for alleged shortage of wheat in godowns under supervision of civil servant
both enguiry officer and authorised officer had absolved civil servant of charges against him and both, had recommended entire loss or shortage to be written off
Even Authority had generally agreed with findings and recommendations of both Enquiry Officer and authorised officer, but despite that imposed penalty on civil servant without giving any basis for conclusions drawn by it
Alleged shortage of wheat in case of civil servant was much less as compared to other two civil servants whose shortage was written off by Authority on same date
Such variation had made it abundantly clear that decisions of Authority were arbitrary and no uniform standard or formula had been applied by Authority in deciding cases
Authority was otherwise empowered to write off losses to the extent which were attributed to civil servant
