Criminal Miscellaneous No. 670/B of 1987, decided on 28th March, 1987. ‑‑S. 497‑‑Offence of Zina (Enforcement of Hudood) Ordinance (VII of 1979), Ss. 10 & 16‑‑Bail, grant of‑‑Petitioners allegedly living in adultery but husband not complainant against them‑‑Petitioners also claiming to have lawfully married each other and the woman already having filed a suit for jactitation of her marriage which too pending decision‑ Petitioners allowed bail, in circumstances. Mian Muhammad Jamil Akhtar for Petitioners. Malik Rehmat Khan Awan for the State. Sajjad and Mst. Maqsooda petitioners are accused of the offences under section 10/16 of the Hudood Ordinance. Case was registered against them on 15‑1‑1987 at Police Station, Sillanwali.

2. Ehsanullah, stepbrother of Mst. Maqsoodan made a report to the police that the two are living in adultery because Mst. Maqsoodan was previously married to one Ashiq. Petitioners claim to have lawfully married each other. Mst. Maqsoodan has filed a suit for the jactitation of his marriage which is also pending. The husband is not the complainant in this case. Under the circumstances the petitioners are allowed bail in the sum of Rs.5,000 (five thousand) with two sureties each in the like amount to the satisfaction of the A.C./Duty Magistrate, Sargodha, pending trial. S.G.D./S‑37/L Bail granted.
