Criminal Procedure Code (V of 1898)‑‑ ‑‑‑S.497‑‑Penal Code (XLV of 1860), 5.471‑‑Offences in Respect of Banks (Special Courts) Ordinance (IX of 1984), S.6‑‑Bail, grant of‑‑Agricultural pass‑book was prepared by the Patwari‑‑Accused, a bank official only processed the loan application and sanctioned loan on the basis of said pass‑book‑‑Accused validly acted in connection with the pass‑book‑‑No reasonable grounds existed to believe that accused had committed any scheduled offence‑‑Bail granted in circumstances. The accused had only processed the loan application and recommended the grant of loan on the basis of Agricultural Pass Book prepared by Rehmat Khan Patwari and duly signed by the Halqa Girdawar and the Naib Tehsildar. If there was any false entry therein the accused petitioner could not be expected to have known that. The pass‑book was under section 4(3) of the Loans for Agricultural Purposes Act (XLII of 1973) in the nature of a title deed and the accused petitioner could validly act upon the same. On the tentative assessment of the evidence as available on the record, I am of the view that there are no reasonable grounds to believe that the accused petitioner has committed any scheduled offence. I, therefore, grant him bail in the sum of Rs. 2 lacs with one surety in the like amount to the satisfaction of the Registrar of this Court. SA./38/S.P.B Bail granted.
