Judgment & Decree
RAWALPINDI‑Respondent Appeal No. 223 of 1958‑59, decided on 7th February 1961, District Rawalpindi. Route permit‑Grant of new route permit‑Genuine‑need of public to be taken into consideration. Abdur Rahim for Appellant. Nazir Ahmad for R. T. A. The appellant company had applied to the R. T. A. Rawal pindi for .two permits to ply between Jalalpur and Pind Dadan Khan in the Jhelum district. The application was made on the suggestion of the Deputy Commissioner of the district who had been approached by the local inhabitants. Jalalpur Police Station is included in the jurisdiction of Pind Dadan Khan Sub‑division and the request of the public for a direct bus service between these two stations can be easily appreciated. The R. T. A., however declined to grant the application of the appellants. as in their opinion the existing facilities between Jhelum and Pind Dadan Khan were sufficient. This argument cannot be accepted in view of the recommendations made more than once by the Deputy Commissioner, Jhelum. There is evidently a genuine need other wise the local D. C., would not have persisted in writing to the R. T. A. I would accordingly accept the appeal and direct the R. T. A. to grant the two permits applied for. K. M. A. Appeal accepted.
