Entitlement to protected Secretariat Pay Scale

Appellant was employee of former Irrigation Department of Ex-Bahawalpur State; became employee of West Pakistan Government at the time of integration of one Unit

Finance Department giving sanction for grant of secretariat consolidated pay scales to all such officials who were serving in the former is Irrigation Bahawalpur Secretariat on specified date

Appellant's name being included in the list approved by the Finance Department such department as well as Accountant-General fixed/verified pay of appellant in the Secretariat Pay Scales and made entries in the Service Book

Appellant was thus, correctly given the Secretariat Pay Scale.

Accountant General did not accept entitlement of appellant to the Secretariat Pay Scale -- Appellant had received such pay scale before Accountant General's letter orders were issued for recovery of overpayment on account of Secretariat Pay Scales from pension/gratuity of appellant

Appellant having been found entitled to protected Secretariat Pay Scale, orders of Accountant-General and follow up orders of concerned officers for recovery of amount from appellant were set aside

Appeal was accepted in circumstances.
