  • 2. In accordance with the terms of the compromise the custody of the minor has been given to her mother, Mst. Shahnaz Kausar. She shall arrange meeting of the minor with the father in the office of Mr. M. Zafar Yaseen, Advocate Supreme Court, at his office 77‑Jail Road, Multan on alternate Fridays. The first meeting shall be held on 20‑5‑1988. This arrangement will continue till the final decision of the case by the Guardian Judge, Muzaffargarh. The minor will be produced before the Guardian Judge as and when directed.

(a) Guardians and Wards Act (VIII of 1890)‑‑‑ ‑‑‑S.25‑‑‑Constitution of Pakistan (1973), Art.185(3)‑‑‑Custody of minor‑‑ Petition for leave to appeal converted into appeal in view of arrangement between the parties over the custody of the minor. (b) Guardians and Wards Act (VIII of 1890)‑‑‑ ‑‑‑S.25‑‑‑Constitution of Pakistan (1973), Art. 185(3)‑‑‑Custody of minor was given to mother as per terms of compromise‑‑‑Minor's meeting with her father was to be arranged in the office of husband's counsel on specified days and such arrangement would continue till the final decision of case by the Guardian Judge, minor would be produced before the Guardian Judge as and when required and for due performance of the arrangement arrived at between the parties, mother and her father had executed a surety bond which was placed on record.

(b) Guardians and Wards Act (VIII of 1890)‑‑‑ ‑‑‑S.25‑‑‑Constitution of Pakistan (1973), Art. 185(3)‑‑‑Custody of minor was given to mother as per terms of compromise‑‑‑Minor's meeting with her father was to be arranged in the office of husband's counsel on specified days and such arrangement would continue till the final decision of case by the Guardian Judge, minor would be produced before the Guardian Judge as and when required and for due performance of the arrangement arrived at between the parties, mother and her father had executed a surety bond which was placed on record. SAAD SAOOD JAN, J.‑‑In view of the fact that there his been an arrangement between the parties over the interim custody of the Minor, this petition has been converted into appeal.

2. In accordance with the terms of the compromise the custody of the minor has been given to her mother, Mst. Shahnaz Kausar. She shall arrange meeting of the minor with the father in the office of Mr. M. Zafar Yaseen, Advocate Supreme Court, at his office 77‑Jail Road, Multan on alternate Fridays. 3. For the due performance of the arrangement arrived at between the parties, Mst. Shahnaz Kausar and her father have executed a surety bond which has been placed on the record.

4. The appeal is accordingly disposed of. There will be no order as to costs. A.A./M‑933/S Order accordingly.
