Judgment & Decree
Writ Petition No.2351 of 2002, decided on, 1st April, 2002. ‑‑‑‑Arts.199 & 212(2)‑‑‑Civil service‑‑‑Transfer of civil servant‑‑‑ Constitutional petition, competency of‑‑‑Petitioner in his Constitutional petition had challenged his transfer from one place of working to another‑‑ Posting and transfer of a Civil Servant was a matter pertaining to terms and conditions of service and dispute with regard thereto fell within exclusive jurisdiction of Service Tribunal under cl. (2) of Art.212 of Constitution of Pakistan (1973)‑‑‑Constitutional petition, in circumstances was not competent. Khizer Hayat Khan Punnian for Petitioner. The writ petitioner has challenged order dated 8‑3‑2002. passed by D.F.O., Layyah (respondent No. 1) whereby writ petitioner was transferred from Lease Branch D.F.O., Office to Inayat Sub‑Division, Chowk Azam of the Forest Department vice respondent No. 3. as without lawful authority and of no legal consequence.
2. Posting and transfer of a civil servant is a matter pertaining to terms and conditions of service and a dispute with regard thereto falls within the exclusive jurisdiction of the Service Tribunal under clause(2) of Article 212 A of the Constitution. Writ petition is, therefore, not competent and it is accordingly dismissed in limine. H.B.T./M‑1280/L Petition dismissed.
