S. 3/4
Criminal Procedure Code (V of 1898), S.154
Petition for contempt of Court
Petitioner alleging that police had not registered the case against accused despite directions given by High Court in this behalf and thus committed Contempt of Court
Police Officer asserted that as directed by High Court he had registered the case against the accused which was under investigation
Allegation was that despite repeated requests the attitude of the police towards the complainant was not in accordance with law
High Court disposed the petition with observation that police official being a creature of the statute was bound to act according to law and complainant could repeat his request if his grievance still persisted. Ch. Younis Ali Suleria, Advocate. Learned counsel states that an application was moved to the S.H.O. for registration of a case on 10-10-1994 and later on Writ Petition No.13608 of 1994 was filed by the petitioner for seeking direction from this Court. On 17-11-1994 the S.H.O. was directed that if the complaint of the petitioner discloses commission of a cognizable offence, he shall proceed further in accordance with law. Learned counsel contends that instead of registering the case of the S.H.O. got the signatures of the petitioner as well as the paternal uncle for compromise and also got illegal gratification.
2. The S.H.O. states that the case has been registered against the accused on 8-12-1994 and is under investigation. It is alleged that in spite of repeated requests, the attitude of the police is not in accordance with law towards the petitioner. The S.H.O. being a creature of the statute is bound to act in accordance with law. The petitioner may, however, repeat his request, if his grievance still persists. With this direction, this petition stands disposed of. N.H.Q./K-168/1 Order accordingly.
