Judgment & Decree
I have carefully weighed the merits of the parties. I am of the opinion that the respondent has been guilty of standing in the way of the appellant running his service from Mirpur Khas to Khipro by hook or crook and causing him trouble and loss by 'preventing his running of his bus for some four months when, even according to the respondents' counsel, the decisions of the R. T. A. confirmed by the Member Board of Revenue, could not have been stayed by the Civil Court. The conclusion I have come to on the whole, however, is that there is no reason to upset the decision of the R. T. A. in the respondents' favour. The R. T. A. ought, however, to have insisted that the respondent maintain a reserve fleet of 33‑1/3 percent to ensure regularity in the efficient running of services. I would uphold the order of the R. T. A., but would add this condition that the respondent increase his number of buses, in order to provide this reserve fleet within six months. As for the merits of the appellant's claim, he now prays that his existing `B' Part from Umerkot to Sumaro be extended upto Mirpur Khas on this route in order to make it a remunerative one. A certificate from Secretary R. T. A. produced by him shows that he has acquired one surplus vehicle, H D A 813 Chevrolet 1950 model. I think his prayer is reasonable, as it would enable him to set up workshop and other facilities at Mirpur Khas not only for this route, but also for the Mirpur Khas‑Khipro route. Moreover, the new vehicle he has acquired will serve as a reserve in case of breakdowns along both the routes and will help in the efficient running of the two routes. The appeal is, therefore, accepted to this limited extent that the `B' Part Umerkot to Sumaro is extended upto Mirpur Khas. K. M. A. Appeal accepted.
