2. This transfer application under section 526, Cr.P.C. has been moved by the applicants/accused for seeking transfer of Sessions Case No.215 of 2002 (The State v. Ali Muhammad and others) from the Court of IVth Additional Sessions Judge, Dadu to any other Court at Dadu, having jurisdiction in the matter. The only ground urged in the, transfer application is that private parties to the above referred Sessions Case arising out of Crime No.47 of 2002 have compromised their dispute, but due to the non‑availability of the Presiding Officer of the concerned Court, the matter could not be disposed of. Mr. Anwar H. Ansari, the learned State Counsel has no objection for transfer of above referred case, so also the opponent No.2 Nazeer Ahmed, who is complainant in the case, has any objection. In view of the above this criminal transfer application is allowed in the terms that the learned District and Sessions Judge Dadu, shall transfer Sessions Case No. 215 of 2002 either to his own Court or to any other Court at Dadu having jurisdiction in the matter. Disposed of. H.B.T./A‑161/K Application allowed.
