Petitioner had sought directions for issuance of degree, without further lapse of time as she had appeared and qualified for the same

Judgment & Decree

The petitioner seeks directions for issuance of MBA Degree without further lapse of time as she has appeared and qualified for the same. According to comments the respondents stated in conclusion that "the petitioner may be directed to appear in the viva voce to qualify for award of MBA Degree as per rules and regulations of the respondent University." According to learned counsel for the petitioner the petitioner has received call letter for the viva voce, but in view of pendency of this petition she could not avail the same,' in the circumstances since any substance, right and entitlement of the petitioner is not disputed, only controversy was her appearance for viva voce in Islamabad or at Karachi as may be deemed appropriate by the university concerned. We would direct that the respondent shall issue fresh call letter to examine and evaluate viva voce to the petitioner without being influenced of the fact that the petitioner has approached this Court to seek some relief. It is expected that petitioner will be meted out a proper treatment in accordance with law. Call letter be issued preferably within a period of three days from today giving reasonable time to, the petitioner to make arrangement to appear before the concerned authority. This petition stands disposed of in the above terms. H.B.T./S-94/K???????????????????????????????????????????????????????????????????????????????????? Order accordingly.
