MASOOD AHMED KHAN and others‑‑Respondents High Court Appeal No. 106 of 1984, decided on 4th February, 1987. ‑‑‑Ss. 7, 8 & 9‑‑Appointment of guardian of insane minor‑‑Application for‑‑Jurisdiction of Court‑‑Permanent residence of insane minor girl was at place 'K' and father of such minor who had made gift in her favour at place 'K' and also had died there‑‑District Court at place 'K' and not at place 'L', held, would have jurisdiction to entertain and decide application for appointment of guardian of such minor, even if minor at present was residing at place 'L'. ABDUL QADEER CHAUDHARY, J.‑‑The appellant has challenged the order of the learned Chief Justice whereby he dismissed the application moved by the appellant for appointing him as the guardian of insane person Miss Zakia Sultana who was lodged at Fountain House of Lahore on the ground that as the insane person is residing at Lahore, therefore, this Court has no jurisdiction and only the Lahore District Court has jurisdiction. The appellant in person has) submitted that the father of the insane had died at Karachi and he had made a gift in favour of the insane at Karachi. The permanent residence of the insane person is in Karachi. In support of his contention he has filed some documents with the affidavit. As the permanent residence of Miss Zakia Sultana at Lahore is not controverted by any document, therefore, we accept this appeal, set aside the order of the learned Single Judge and hold that this Court has jurisdiction in the matter. The appeal is allowed and the case is remanded for trial. H. B.T.0‑258/K ‑‑‑‑‑‑ Appeal allowed.
