Judgment & Decree
S. M. Kohistani for Applicant. Date of hearing: 18th May, 1989. DECISION This is Revision Application against the order of the Third Sind Labour Court, Karachi, dated 14‑12‑1988, whereby the learned Sind Labour Court dismissed the complaint of the applicant against the respondent on the ground that he had failed to establish that the accused had committed any offence. The original complaint had been filed against five accused persons whereas Revision has been pressed against only one of them namely Khalid Shafi. 2. Mr. S.M. Kohistani, learned counsel for the applicant was asked by this Tribunal 'to produce document prima facie to show that the respondent was Director of the Company to make him liable for the offence under section 11(4) of the Standing Orders Ordinance. Offence is alleged to have been committed on 26‑3‑1982. No evidence has been produced on the record that Mr.Khalid Shafi was Director of the Company at the relevant time. Mr. Kohistani was asked to produce the extract from the Register of the Office of the Registrar of the Companies. He has produced certified copy to show that the respondent was Director in 1984. The date of his appointment is shown as 5‑8‑1984. However, even this document does not show that the respondent was Director at the relevant time so as to make him liable for the alleged offence. 3. Under the circumstances I rind no ground for interference in exercise of Revisional Power of this Tribunal. 4. The Revision Application is, therefore, dismissed in limine. A.E./1443/Lb.S Revision dismissed.
