Miscellaneous Application of 1969, decided on 1st November 1969. --‑Pleadings ‑--Objection as to validity, of constitution of statutory special Tribunal‑Cannot be decided by the Tribunal itself. While repelling an objection that the Industrial Court had not been properly constituted the Industrial Court held, "this Court is a Special Tribunal created by a special statute and therefore, it cannot suspend itself, and as such this matter is not for this Court to decide. Akhtar Ali Pervez v. Altafur Rehman P L D 1963 Lah. 390 rel. A. M. Qureshi for Petitioner. M. JAMIL ASGHAR (CHAIRMAN): An application has been filed that the proceedings against the respondent, in a complaint under section 35 of the Industrial Disputes Ordinance, 1968, be stayed because this Court , has not been properly constituted. In this petition the' appointment of two members has been challenged. In the first instance we find that no such proceedings under section 35 of the Industrial Disputes Ordinance are, pending. That complaint was dismissed by this Court on 21‑10‑1969. Even if those proceedings had been pending, the present petition cannot be entertained. This Court is a Special Tribunal created by special statute and therefore, is cannot suspend itself, and as such this matter is not for this Court to decide. We are fortified in this; view by a Full Bench of the High Court in case Akhtar All Pervez v. Altafur Rehman (P L D 1963 Lah. 390). In view of the above this petition is dismissed.
