Criminal Procedure Code (V of 1898)‑‑‑ ‑‑‑‑Ss.491 & 497‑‑‑Penal Code (XLV of 1860), S.380/458‑‑‑Bail, grant of‑‑ Bailiff in pursuance of order of High Court proceeded to police station concerned and found accused confined there ‑‑‑Accessed, according to police was arrested in a case registered against him under S.380/458, P.P.C. whereas according to report of Bailiff accused was not nominated as an accused in F.I.R. and such factual position was not controverted by Police Officer‑‑ Habeas corpus petition was converted into bail petition and accused was granted bail for a period of ten days to enable him to move a competent Court, which would decide his bail petition on merits.
Judgment & Decree
In pursuance of the order of this Court dated 4‑6‑1995,"a bailiff of this Court proceeded on the same day to Police Station People's Colony, Gujranwala and reached there at 6‑35 p.m. According to the report of the bailiff Iqrar Ali alias Mona was found confined at the said police station. Accordingly, the bailiff of this Court directed the police officer concerned to produce Iqrar Ali alias Mona in this Court today. Iqrar Ali alias Mona is now present in Court in hand.
2. S.I. Muhammad Ashraf, Incharge Police Post, People's Colony, Gujranwala, states that Iqrar Ali alias Mona was arrested on 4‑6‑1995 in pursuance of F:I.R. No.159 of 1995 dated 25‑5‑1995 under section 458/380, P.P.C. registered at Police Station, People's Colony, Gujranwala, vide Rappat No.7 dated 4‑6‑1995.
3. According to the report of the bailiff Iqrar Ali alias Mona is not nominated as an accused person in the aforesaid F.I.R. No.159 of 1995. This factual position is not controverted by police officer.
4. Resultantly this habeas corpus petition is controverted into a bail petition. Iqrar Ali alias Mona is granted bail for a period of ten days to enable him to move a competent Court at Gujranwala provided he furnishes bail bond in the sum of Rs.25,000 with one surety in the like amount to the satisfaction of A.C./Duty Magistrate, Gujranwala.
5. In case Iqrar Ali alias Mona moves a petition for bail within ten days before the competent Court at Gujranwala, the said Court shall decide his bail petition on merits. . With these observations this habeas corpus petition which has been converted into a bail petition is disposed of. H.B.T./Z‑162/L Petition disposed of.
