Petition under S. 491, Cr.P.C.--Statements of detenus and record produced before High Court by police officials showed that detenu was found in custody of police officials without any legal justification/authority; was subjected to physical violence and medico-legal report showed that he was inflicted 19 injuries and some of the injuries were located at the private parts of the detenu
High Court in exercise of its power under C1.22, Letters Patent (Lahore) directed the Senior Superintendent of Police, to conduct the preliminary investigation in respect of omission and commission of acts/offences of the said subordinate police officials and resultant action taken be intimated to the High Court.

Judgment & Decree
police officers are under statutory duty to watch the performance of subordinate police officials and see that they do not transgress their powers. The superior police officers have been given power to take departmental as well as criminal actions in respect of the delinquent officials. : :.r.,-u The allegations, material pertaining to omission and commission of acts/offences by Police Officials thus required preliminary investigation. High Court under para. 22 of the Letters Patent, directed the Senior Superintendent of Police, to conduct the preliminary investigation in respect of omission and commission of acts/offences committed by concerned subordinate Police Officials.
