Judgment & Decree

Miscellaneous Application No. LHR‑593 of 1987, decided on 20th December, 1987. ‑‑‑Ss. 37 & 38‑‑Review‑‑Tribunal has no powers of review‑‑Appellate Tribunal decided appeal of Bank employee on ground that Labour Court and Tribunal had no jurisdiction‑‑Re‑hearing of appeal sought on ground that Supreme Court on the basis of a rule laid down had held that Labour Courts had jurisdiction‑‑Re hearing refused by Tribunal on the ground that Tribunal could not review its own order. H.R. Haider for Petitioner. M.S. Bokhari for Respondents. Date of hearing: 20th December, 1987. This is a miscellaneous application for re‑hearing of the appeals, one brought by the bank and the other by the petitioner. The learned lower Court had directed the reinstatement of the petitioner without back benefits. The Bank challenged the order of reinstatement whereas the petitioner brought appeal for back benefits. Following 1985 P L C 1053 it was held by this Tribunal vide decision dated 26‑5‑1986 that Labour Courts and this Tribunal had no jurisdiction. The ruling referred to above, was of the High Court and was challenged before the Supreme Court in some cases. The Supreme Court has now held that the Labour Courts have jurisdiction in Banks' cases. For this reason the petitioner has applied for the rehearing of the appeal. Since this Tribunal has no powers of review, the order dated 26‑5‑1986 cannot be set aside or reversed. Till the said order stands, I am not in a position to take up the matter again. It has been argued by the learned counsel for the petitioner that the grievance petition returned to the petitioner vide order dated 26‑5‑1980 of this Tribunal was presented to the National Industrial Relations Commission (N.1.R.C.) and from there it has been returned to him on account of the finding given by the Supreme Court in other cases. May it be so but the position is the same, that this Court cannot review its own order.

2. As a result the miscellaneous application is dismissed. A.E./484/Lb. P Application dismissed.
