Entitlement to A.C.C. Railway Journey pass
Civil servant who had been retired from service, claimed relying upon paragraph 134 of Railway Passes Manual that he was entitled to A.C.C. Class with effect from date of his acting charge appointment in Basic Pay Scale (B.P.S. 17)
According to Paragraph 134 an employee who had retired from service and who was eligible for railway passes while in service, could be given passes for himself and his family according to prescribed scale
A.C.C. Railway pass admittedly was never issued to civil servant during course of his service
Civil servant in circumstances, was not entitled to such a pass as a matter of right especially when such passes were issued to civil servant only as a matter of privilege and not in acknowledgment of any right
Civil servant had prayed for direction to Authorities to make payment of differences of fare on A.C.C. Pass and sleeper class to enable him to recoup expenditure incurred by him
No expenditure admittedly was ever incurred by him as he travelled in Sleeper class on basis of passes issued to him from time to time and neither travelled in A.C.C. class nor incurred any expenditure
