Service of civil servant holding post of Chief Inspector of Boilers, was terminated on charge-that for purpose of securing employment, he produced a false and tampered with certificate of First Class Competency purported to have been issued by Foreign Authority, which actually was Third Class Competency Certificate, but by tampering with the same, it was made to appear as First Class Competency Certificate
On such allegation, civil servant was found ineligible for appointment he got as he did not possess essential qualification of `First Class Competency Certificate' for his appointment
Civil servant not only had denied allegations of tampering with the certificate but also had denied that he had ever produced First Class Competency Certificate
Civil servant, was also prosecuted in Court of Special Judge Anti-Corruption on the same charge of producing forged document for obtaining employment, but was acquittrud
Apart from judgment of Court in favour of civil servant, material available on record, was not enough to prove that civil servant had deliberately produced certificate in question intending thereby to dupe Authorities about his qualifications
Post of Inspector of Boilers admittedly was to be filled by initial recruitment on recommendations of Public Service Commission from amongst candidates possessing (i) Diploma in Mechanical or Electrical Engineering from recognised Institution (ii), First Class Engineer's Competency Certificate and (iii) Three years' .practical experience in repair and maintenance of steam boiler
Basic requirement viz. possessing First Class Engineer's Competency Certificate, had remained unfulfilled as civil servant had produced only Third Class Competency Certificate instead of First Class Competency Certificate, civil servant was not eligible for post
