Through instant petition, Naveed Hussain (petitioner/ accused) has sought post-arrest bail in case arising out of FIR No.1041/2025 dated: 26.04.2025 registered under Section: 9(1) (6) (c) of the Control of Narcotic Substances Act, 1997 at Police Station: Defence-C, Lahore.

After hearing learned counsel for the petitioner, learned Additional Prosecutor General and going through the available record with their able assistance, it has been noticed that briefly, as per crime report (FIR) got recorded by Tanveer Ahmad, S.I. (complainant), on 26.04.2025, Heroin weighing 1100-grams was recovered from present petitioner. Learned Additional Prosecutor General under instructions of aforementioned police officials (present before the Court) and after himself going through the available record apprises that as per allegation levelled in the crime report (FIR), 1100-grams Heroin was recovered from the petitioner, however, when sample taken out from the same was sent for chemical analysis, it has not been found as Heroin as per report of Punjab Forensic Science Agency, Lahore (available on the record). Said Report is hereby scanned for ready reference:- In view of above, case of prosecution against the petitioner, at present, requires further probe/inquiry within the purview of sub-section 2 of Section 497 Cr.P.C. and it has now become a case for grant of post arrest bail.

For the foregoing reasons, instant petition filed by Naveed Hussain (petitioner) for grant of post arrest bail is allowed and petitioner is admitted to bail in the case subject to his furnishing bail bonds in the sum of Rs.3,00,000/- (Rupees three hundred thousand only) with two sureties each in the like amount to the satisfaction of trial court.

4. It is, however, clarified that observations mentioned above are just tentative in nature and strictly confined to the disposal of instant bail petition.

Before parting with this order, we feel it necessary to add that chemical formula of Heroin is C21H23NO5, its Molecular weight is 369.417 g/mol., its chemical name is diacetylmorphine and also known as diamorphine. Molecular structure of Heroin is as under:- Heroin does not have a single Chemical Code , rather it is identified by several standardized chemical codes and names. The technical, scientific/systematic name as per International Union of Pure and Applied Chemistry (IUPAC) for Heroin is (5a,6a)-7,8-didehydro-4,5-epoxy-17-methylmorphinan-3,6-diol diacetate. It is a semi-synthetic opioid. It is manufactured from morphine, a natural substance extracted from the seed pod of the opium poppy. When Heroin enters the body it is quickly metabolized into other compounds. It is first broken down into 6-monoacetylmorphine (6 MAM) and then further into morphine which then binds to opioid receptors in the brain. Substance usually may be organic or inorganic; laboratory through analysis can determine that it is organic or inorganic substance and furthermore can also see its chemical composition. Now question does arise that if substance sent in this case to Punjab Forensic Science Agency, Lahore was not found as Heroin then what was it? What was its chemical composition/formula, structure, molecular weight and chemical code as well as properties/sedative or toxic effect? But report of Punjab Forensic Science Agency, Lahore in this case is silent on these vital aspects. Therefore, Director General of Punjab Forensic Science Agency, Lahore will ensure in future that chemical composition/formula, chemical name, structure, molecular weight, chemical code and chemical properties/sedative or toxic effect of the substance will be mentioned in the report in crystal clear manner i.e. in black and white. And if for any valid reason, it is not possible for the laboratory to determine the exact nature of the substance or detail of its components, then laboratory has to give comprehensive detail as well as reasons in the report, in this regard. Investigating Agencies of the narcotics cases shall emphasize for and get the report containing aforementioned details from the laboratory.

6. Registrar of this Court will send copy of this order to Director General of Punjab Forensic Science Agency, Lahore, Director General of Anti-Narcotics Force and Inspector General of Police, Punjab Lahore for information as well as compliance, after due process. MQ/N-34/L Bail granted.
