Writ Petitions pertaining to the eviction of Hamayun and Javaid petitioners were disposed of by this Court on 30-1-1991 and the orders of the learned Rent Controller and that of the learned Additional District Judge dismissing the ejectment petition filed against the petitioners were set aside and the matter was remanded to the learned Rent Controller for proceeding in accordance with law.
2. Hamayun petitioner who is a tenant in the premises in question has filed this petition for clarification of the order dated 30-1-1991 passed by this Court whereby the learned Rent Controller was directed to dispose of the case in accordance with law. It is stated that the learned Rent Controller has informed the petitioner that he is simply to pronounce order without affording any opportunity to the parties to adduce evidence.
3. Since the matter has been disposed of by this Court no occasion for clarification of the order, dated 30-1-1991 arises. Anyhow, while dismissing the application I observe that the learned Rent Controller shall be at liberty to hold such inquiry as he may deem fit for the proper disposal of the ejectment petition, H.B.T./M-3058/L Order accordingly.
