Objection to the appointment of Authorised Officer-- Validity
Anybody can be appointed as Authorized Officer by the Authority for proceeding against an employee of Assembly Secretariat under Efficiency and Discipline Rules, 1977
Post of Deputy Secretary, of Assembly Secretariat having stood abolished at the relevant time, Authority had to make some alternate arrangements and for that reason, in exercise of its powers vested in it under Legislative Assembly (Efficiency and Discipline) Rules, 1977, appointed staff officer of Assembly Secretariat to act as Authorized Officer-- Show-cause notice issued to civil servant by Authorized Officer was more like a charge-sheet, thus, no further inquiry was necessary in the matter and Authorized Officer had wisely referred the matter alongwith his recommendations to the Authority for awarding major punishment to civil servant
No personal hearing was necessary and Authority was quite competent to make the order in question
No violation of rules had taken place and civil servant had been rightly punished for having admitted his guilt
Civil servant having been rightly punished for his misconduct, any further indulgence could spoil good administration of Assembly Secretariat.
