Seniority-cum-fitness-- Appellant was inducted into service as Technical Teacher of Education Department while respondent also entered in service of that Department at a later stage
Appellant took exception to the seniority of respondent on the basis of selection of Board of Governors whereby he was placed at a position below respondent for appointment of Vice-Principal in National Agro Technical Centre
Both, appellant and respondent .were enjoying Pay Scale No. 17 and it was at the recommendation of the Board' of Governors that position allotted to appellant in previous seniority list was changed and he was placed at serial No. 2 next after the respondent
Seniority of appellant was considered in the meeting of Selection Board when case of appellant as well as that of respondent for post of Vice-Principal of Centre was taken up and a draft seniority list was prepared, accepted by Government and submitted by Education Department
Appellant also failed to prove any malice on part of department
Seniority-cum-fitness of appellant as well as that of respondent determined by Selection Board of Azad Jammu and Kashmir was not appeal able before Service Tribunal
Appeal was therefore dismissed.
