Judgment & Decree
Revision Side No. 140 of 1960‑61, decided on 30th August 1961, District Lahore. Route permit‑Grant of‑New concern with no special record, not to be allowed to interlope in Region other than own. This appeal is against the decision of the R. T. A., Lahore, in their meetings held on 16th to 18th and 24th February 1961, in which they granted two stage carriage permits on Lyallpur Aminpur route to Local Bus Service Lyallpur (Respondent No. 2) and rejected the application of the appellant Company. The main point urged before me in appeal is that the appel lant Company has experience in transport business and ought to have been preferred over respondent No.
2. It is admitted by the appellants that Langrial Bus Service was formed in 1955 as a partnership. In 1958 it was converted into a Limited Company with Headquarters at Gujrat. 1t is admittedly a new concern without having run any Transport Service. Very little stands to purchase on X60, of two 155 Model Buses. Both these were made over on the very dates of purchase on what is called "hire purchase terms to Lyallpur Co‑operative Society, who have been running the same ever since. It will be clear from this record that the appellant can put forward no claim to preference over respondent No. 2, who have been running the Local Bus to the satisfaction of the R. T. A., Lahore. The appellants have been advised that since they are new comers, they should first convince their own R. T. A. (Rawal pindi), that they deserve to be granted routes, rather than compete on routes in Lahore Region. It would be wrong in principle for a new concern with no special record instead of applying within its own Region, to interlope in another Region's routes and expect that it will be preferred to companies with much better claims from that Region. S.B. Appeal rejected.
