Thereafter, Constitution Petition No.111 of 2012 was filed on behalf of Syed Munawwar Hassan, Amir Jamat-e-Islami and 2 others with, inter alia, the prayer that the electoral rolls prepared by the ECP which are tainted with irregularities and errors in the Province of Sindh especially Karachi be declared illegal, unlawful and that the respondents be directed to revise the electoral rolls and to correct the same on the basis of the present address of the voter in the city where he is residing. Mr. Saleem Zia, Secretary General, Pakistan Muslim League (N) Sindh filed Constitution Petition No. 123 of 2012 with an identical prayer. On 22-11-2012, Dr. Farogh Naseem, learned Advocate Supreme Court filed C.M.A. No. 4840 of 2012 on behalf of Muttahida Qaumi Movement (MQM) for impleadment as a co-respondent and giving him a right of audience on behalf of the intervener, which was allowed on the same day. All these matters have been heard together.

The main grievance raised before us by the learned counsel for the petitioners is that the judgment of this Court in the case of Workers' Party Pakistan (supra) has not been complied with in its letter and spirit by the ECP, inasmuch as, there have been gross errors and irregularities in the preparation of the Electoral Roll of Karachi wherein a large number of voters have been disenfranchised and their names have been removed from the Electoral Roll. In response to the above, a rather evasive reply has been submitted on behalf of the Election Commission which is of not much significance, in the presence of the material, placed before us, including a comparative statement of the Electoral Roll, wherein 663 electors have been registered to be the residents of House No.E-43, PECHS, Block-II, Karachi, allegedly constructed on a 120 square yards. And the statement made by Dr. M. Shamim Rana, Advocate Supreme Court that names of a large number of voters have been deleted from the Electoral Roll of Karachi and shifted to different parts of the country arbitrarily including his own vote. To further demonstrate his pleas, he has also referred to relevant material filed by him through C.M.A. No.4830 of 2012. Mr. Hamid Khan, Senior Advocate Supreme Court contended that according to credible information, while revising the voter lists, as per commitment of the Secretary, ECP, made in the order dated 4-7-2011, only 10% voters were approached by the Electoral Staff.
- Reference in this behalf may also be made to the judgment of this Court reported as Mubasher Luqman v. Federation of Pakistan and others (PLD 2011 SC 775). Thus, in the light of the law laid down in the aforesaid cases, it is clear that this Court, under Article 184(3) of the Constitution, not only has the jurisdiction to pass appropriate orders in the cases involving questions of public importance with reference to enforcement of fundamental rights guarabteed under the Constitution but is also empowered to ensure fulfillment of the command of the Constitution of holding elections honestly justly, fairly and in accordance with law. Hence, these petitions are held to be maintainable and the grievances raised therein are justiceable by this Court in the present proceedings. The objection raised by Dr. Farogh Naseem, learned Advocate Supreme Court appears to be misconceived and the judgments relied upon by him irrelevant in the facts and circumstances of the case.

SH. AZMAT SAEED, J.
The Constitution of the Islamic Republic of Pakistan, 1973 envisages a parliamentary system of government. It provides for a Parliament (National Assembly and the Senate of Pakistan) for the Federation and the Provincial Assemblies for the provinces. The people are to be governed by their chosen representatives and the Fundamental Rights including Article 17 guaranteed under the Constitution are to be enforced. It may be advantageous to reproduce the said Article, which reads as under:-- Freedom of association: (1) Every citizen shall have the right to form associations or unions, subject to any reasonable restrictions imposed by law in the interest of sovereignty or integrity of Pakistan, public order or morality. (2) Every citizen, not being in the service of Pakistan, shall have the right to form or be a member of a political party, subject to any reasonable restrictions imposed by law in the interest of the sovereignty or integrity of Pakistan and such law shall provide that where the Federal Government declares that any political party has been formed or is operating in a manner prejudicial to the sovereignty or integrity of Pakistan, the Federal Government shall, within fifteen days of such declaration, refer the matter to the Supreme Court whose decision on such reference shall be final. (3) Every political party shall account for the source of its funds in accordance with law.

A comprehensive mechanism is provided to facilitate the people to choose their representatives in accordance with the Constitution and the laws on the subject regulating different aspects of the election process including Articles 218 and 219 of the Constitution and the Electoral Rolls Act, 1974. Under Article 218(3), it is the duty of the Election Commission of Pakistan to organize and conduct the elections and to make such arrangements as are necessary to ensure that the election is conducted honestly, justly, fairly and in accordance with law, be it a general election or a bye-election. Whereas under Article 219 of the Constitution, the Election Commission of Pakistan is charged with the duty of preparing electoral rolls and revising the same periodically so as to enable all the eligible voters to exercise their right of franchise.

It may be pertinent to mention here that Constitution Petition No. 45 of 2007 was filed by Mohtarma Benazir Bhutto (late) under Article 184(3) of the Constitution with the prayer that the respondents (ECP and others) be directed to update the computerized/electronic voters lists to encompass the names of all persons entitled to vote in terms of Article 51(2) of the Constitution and the condition of CNIC for registration of eligible voters may be declared as without lawful authority and of no legal effect. The said petition came up for hearing before this Court on 10-8-2007, when an order was passed, relevant para of which is reproduced herein below:-- "
2. It may be noted that the Election Commission has submitted parawise comments, in which a schedule for the additional entries in the computerized electoral roll 2006-2007 has been provided, according to which a process has commenced from 3rd August, 2007 and it will end on 20th December, 2007 and in this way 140 days are required to complete the same. We have minutely gone through the same. The time being consumed to complete certain steps is on the high side. We believe that such exercise can be completed within a minimum period because the matter is quite simple as on the one hand there is electoral list of the voters prepared for the election of 2002, according to which the number of voters is 71.86 million whereas in the electoral list which has been presently prepared, number of voters has been shown to be 5,21,02,
428. There is approximately a difference of about 2 crores. Therefore, the Election Commission after minusing (sic) the votes, already recorded, has to check only in respect of the genuineness or otherwise of the remaining votes and for that purpose, they can provide forms, etc. to those voters whose names have not been recorded by taking out the names from original list, through post-offices or any means within a minimum time and by increasing the number of staff twice or thrice this exercise can be completed within a period not more than 30 days. However, further improvement in such exercise can also be made by the Commission with a view to minimize the period of recording the names of the left over voters in existing electoral list and to ensure that there must be fair and transparent elections, which are scheduled to be held in the near future."

The case was then taken up on 4-10-2007 when the representative of the ECP stated that in pursuance to the directions of this Court, the exercise has been completed and 27 million voters have been added in the electoral rolls. It was further stated that there were a total of 80 million people who were eligible for exercising the right of vote but some more time would be required to complete the printing and publication of the electoral lists in accordance with the rules. Accordingly, ECP was directed to complete the printing/publishing exercise up to 25-10-2007 whereafter the list would be placed on the website of the Commission.

On 7-4-2011, Mr. Imran Khan, Chairman, Pakistan Tehrik-e-Insaf filed Constitution Petition No. 31 of 2011 with, inter alia, the prayer that the ECP be directed to prepare fresh electoral rolls eliminating all bogus votes and introducing and incorporating the new eligible votes who can be verified from the relevant database and record of NADRA. And to include the names of the voters, as per their addresses given in the CNIC. The petition was heard from time to time and necessary orders were passed. On 4-7-2011, the Secretary ECP appeared before the Court and stated that a Proforma has been prepared allowing the voter to exercise his/her option to vote either at the permanent place of residence or where he/she is temporarily residing on account of his/her place of work, etc., and the option so exercised by him/her shall be printed in the voters list.

In the meanwhile, Workers Party Pakistan filed Constitution Petition No.87 of 2011 with, inter alia, the prayer that the prevailing electioneering practices involving wealth, power and influence are against the mandate of the Constitution and are an impediment to a free, fair, just and honest elections on a level playing field, which needs to be remedied. The said petition was disposed of by means of judgment reported as Workers' Party Pakistan v. Federation of Pakistan (PLD 2012 SC 681) wherein it was held and directed, inter alia, as under:-- "(j) To achieve the goal of fair, free, honest and just elections, accurate preparation/revision of electoral roll is immediately required to be undertaken by the Election Commission through credible and independent agencies. Accordingly, we direct the Election Commission to undertake door-to-door checking of voters lists and complete the process of updating/revision of the electoral rolls by engaging Army and the Frontier Corps to ensure transparency, if need be."
7. Thereafter, Constitution Petition No.111 of 2012 was filed on behalf of Syed Munawwar Hassan, Amir Jamat-e-Islami and 2 others with, inter alia, the prayer that the electoral rolls prepared by the ECP which are tainted with irregularities and errors in the Province of Sindh especially Karachi be declared illegal, unlawful and that the respondents be directed to revise the electoral rolls and to correct the same on the basis of the present address of the voter in the city where he is residing. Mr. Saleem Zia, Secretary General, Pakistan Muslim League (N) Sindh filed Constitution Petition No. 123 of 2012 with an identical prayer. 8. We have heard Messrs Hamid Khan, Rashid A. Razvi, Dr. Muhammad Shamim Rana, Dr. Farogh Naseem, Sardar Khurram Latif Khan Khosa, Muhammad Munir Paracha, learned counsel for the parties and Mr. Dil Muhammad Alizai, learned D.A.G.

The main grievance raised before us by the learned counsel for the petitioners is that the judgment of this Court in the case of Workers' Party Pakistan (supra) has not been complied with in its letter and spirit by the ECP, inasmuch as, there have been gross errors and irregularities in the preparation of the Electoral Roll of Karachi wherein a large number of voters have been disenfranchised and their names have been removed from the Electoral Roll. In response to the above, a rather evasive reply has been submitted on behalf of the Election Commission which is of not much significance, in the presence of the material, placed before us, including a comparative statement of the Electoral Roll, wherein 663 electors have been registered to be the residents of House No.E-43, PECHS, Block-II, Karachi, allegedly constructed on a 120 square yards. And the statement made by Dr. M. Shamim Rana, Advocate Supreme Court that names of a large number of voters have been deleted from the Electoral Roll of Karachi and shifted to different parts of the country arbitrarily including his own vote. To further demonstrate his pleas, he has also referred to relevant material filed by him through C.M.A. No.4830 of 2012. Mr. Hamid Khan, Senior Advocate Supreme Court contended that according to credible information, while revising the voter lists, as per commitment of the Secretary, ECP, made in the order dated 4-7-2011, only 10% voters were approached by the Electoral Staff.
10. Learned counsel for the petitioners further alleged that approximately 50% votes of the electors of Karachi have been shifted to other parts of the country and in their places, names of unverified voters have been inserted, which is likely to lead to rigging in the forthcoming elections as a result whereof it would not be possible to fulfil the command of the Constitution of ensuring right of franchise a fundamental right of each actual/real voters, whose names stand verified for the last 2/3 general and bye-elections and the object of holding free, fair, honest and just election will be defeated unless the names of voters are re-verified on a door-to-door basis in accordance with the Constitution and the Law through their CNIC.
11. Sardar Khurram Latif Khan Khosa, learned counsel in Constitutional Petition No.45 of 2007 has urged that an identical complaint was highlighted in the petition filed by Mohtarma Benazir Bhutto (late), the then Chairperson of PPP invoking jurisdiction of this Court under Article 184(3) of the Constitution, now represented by Mr. Jehangir Badar, Secretary General of the Party. He has reiterated the assertion made by Mr. Jehangir Badar, Secretary General, Pakistan Peoples Party while appearing before this Court on 21-11-2012 that the Electoral Roll of Karachi prepared by the ECP contains gross errors/violations, which need to be rectified/corrected as prayed for by the learned counsel appearing on behalf of other petitioners. He has referred to the order of this Court dated 16-8-2007 passed in Constitutional Petition No.45 of 2007, wherein the ECP was directed to complete the exercise within a period of 30 days from the date of the said order, in the light of the observations made in the order dated 10-8-2007 reproduced hereinabove.

Dr. Farogh Naseem, learned counsel for applicant-MQM, on the other hand, has contended that the exercise of preparation of the Electoral Rolls in Karachi has been completed and until the elections are announced, they can be varied and altered at the behest of the individual voter only, and not on the request of any of the political parties and there is no ground for fresh revision of Electoral Roll nor will it be just. In this regard, he has placed reliance upon the cases titled as Lakshmi Charan Sen and others v. A.K.M. Hassan Uzzaman and others (AIR 1985 SC 1233) and C. Lakshmi Narain v. The Chief Election Commission (AIR 1997 Madras 125).

Mr. Muhammad Munir Paracha, learned counsel appearing for the Election Commission, on the other hand, has contended that the exercise of preparing the Electoral Roll of Karachi has already been completed and that the Election Commission has filed its reply in which it has explained its position. He has contended that annual revision of the Electoral Rolls of Karachi at this stage is not permitted by law and such revision can only be carried out in the next year, as the law requires annual revision of the Electoral Rolls. He, however, contended that individual grievances, if raised in accordance with law, can always be entertained and redressed until elections are announced. Mr. Dil Muhammad Alizai, learned DAG has adopted the arguments of Mr. Muhammad Munir Paracha, learned ASC.

Adverting first to the objection raised by Dr. Farogh Naseem, learned counsel appearing on behalf of MQM that the alleged complaints made by the petitioners are individual in nature and mechanism of redressal of such individual complaints is provided for in the Electoral Rolls Act, 1974 and the Rules framed thereunder and the petitioner-political parties have no locus standi to agitate the matter in these proceedings. In the instant case, Article 184(3) of the Constitution has been invoked and suffice it to say that with the passage of time, the scope of jurisdiction of this Court under Article 184(3) of the Constitution has steadily evolved and expanded with its contours now well established through the successive judgments handed down, by this Court. It has been declared that proceedings under Article 184(3) are not limited to adversarial proceedings to be initiated by a wronged litigant seeking redressal of his individual grievance. Likewise, the rule of locus standi has also not been held applicable to the cases involving questions of public importance with reference to enforcement of the Fundamental Rights, especially in the domain of Public Interest Litigation to ensure a meaningful protection of the Rule of Law to all citizens, as has been laid down in judgments reported as Miss Benazir Bhutto v. Federation of Pakistan and another (PLD 1988 SC 416), Mian Muhammad Nawaz Sharif v. President of Pakistan and others (PLD 1993 SC 473), Dr. Akhtar Hassan Khan and others v. Federation of Pakistan and others (2012 SCMR 455) and Muhammad Yaseen v. Federation of Pakistan through Secretary, Establishment Division, Islamabad and others (PLD 2012 SC 132).
15. As regards the objection to the maintainability of the instant petitions under Article 184(3) of the Constitution in the context of elections and the rights of the political parties to agitate for the due fulfillment of the Constitutional and legal requirements in respect thereof, this Court in its judgment reported as Workers Party (supra) has held as under:-- "
33. The scope of jurisdiction of this Court under Article 184(3) of the Constitution by now is fairly settled in a plethora of case-law, therefore, there is no necessity to recapitulate the constitutional provision or to refer to the entire case-law for the purpose of deciding the question of maintainability of the instant petition. This Court, in the cases of Ms. Benazir Bhutto v. Federation of Pakistan (PLD 1988 SC 416), Haji Muhammad Saifullah Khan v. Federation of Pakistan (PLD 1989 SC 166) and Mian Muhammad Nawaz Sharif v. President of Pakistan (PLD 1993 SC 473) has already held that the right to form, or be a member of a political party guaranteed under Article 17 of the Constitution subsumes the right to participate or contest in the election, and to form government if successful. The petitioners have vehemently averred that the impugned practices violate the fundamental right of the citizenry at large guaranteed by Article 17 read with Article 25 of the Constitution. None of the respondents has rebutted the above assertion of the petitioners. Accordingly, the instant petition is held to be maintainable.
34. It may be mentioned here that the instant petition falls in the public interest litigation, which is not adversarial but inquisitorial in nature. In the cases of Watan Party v. Federation of Pakistan (PLD 2011 SC 997) and All Pakistan Newspapers Society v. Federation of Pakistan (PLD 2012 SC 1) referred to by Mr. Farogh Naseem, ASC, this Court has held that it has the jurisdiction to adjudicate upon a case if it falls within the ambit of inquisitorial proceedings. It is also well settled that while entertaining a direct petition under Article 184(3), this Court has ample power to examine the vires of laws, rules or regulations. Reference in this regard has been made to the cases of Wukala Mahaz Barai Tahafaz Dastoor v. Federation of Pakistan (PLD 1988 SC 1263), Farooq Ahmad Khan Laghari v. Federation of Pakistan (PLD 1999 SC 57), Jalal Mehmood Shah v. Federation of Pakistan (PLD 1999 SC 395), Liaquat Hussain v. Federation of Pakistan (PLD 1999 SC 504), Dr. Mobashir Hassan v. Federation of Pakistan (PLD 2010 SC 265) and Muhammad Mubeen-us-Salaam v. Federation of Pakistan (PLD 2006 SC 602)." Reference in this behalf may also be made to the judgment of this Court reported as Mubasher Luqman v. Federation of Pakistan and others (PLD 2011 SC 775). Thus, in the light of the law laid down in the aforesaid cases, it is clear that this Court, under Article 184(3) of the Constitution, not only has the jurisdiction to pass appropriate orders in the cases involving questions of public importance with reference to enforcement of fundamental rights guarabteed under the Constitution but is also empowered to ensure fulfillment of the command of the Constitution of holding elections honestly justly, fairly and in accordance with law. Hence, these petitions are held to be maintainable and the grievances raised therein are justiceable by this Court in the present proceedings. The objection raised by Dr. Farogh Naseem, learned Advocate Supreme Court appears to be misconceived and the judgments relied upon by him irrelevant in the facts and circumstances of the case.
16. We have considered the submissions of the learned counsel for the parties on merits and have also gone through the material placed before us, and also the law relied upon by them.
17. It is the command of the Constitution under Article 218(3) that the Election Commission of Pakistan is charged with the duty to ensure free, fair and just elections in the country, be it a general election or bye-election. Whereas, under Article 219 of the Constitution, the Election Commission of Pakistan is also commanded to revise the electoral list annually, object of which is none else, except that free and fair elections are held.
18. 19. The Election Commission of Pakistan filed a reply vide C.M.A. No.4654/2012, wherein it has admitted that the process of revision of Electoral List pertains to the month of April-May, 2011. Extract from the reply is reproduced herein below:-- "
8. Above-mentioned reasons enforced ECP and NADRA to align their databases with respect to addresses according to New Census Blocks. For this purpose, a Proforma was devised to capture and link current location of families with newly created Census Blocks. These Proformas were filled by enumerators during Housing Census 2011 conducted in April-May 2011 countrywide."
20. The grievance raised primarily with reference to Karachi through the instant Constitution Petitions must necessarily be examined in the above backdrop. It is the case of the Election Commission of Pakistan that door-to-door verification in Karachi has in fact been effected in respect of approximately 82% of the population. This fact is vehemently disputed by the learned counsel for the petitioners, who have contended that such door-to-door verification was not carried out in Karachi, which fact is obvious from the discrepancies and flaws identified by them by way of examples including the rather strange and physically impossible situation of over 600 voters having been registered, as residents of a house measuring 120 Sq. Yards.
21. The primary basis for the Electoral List of the Housing Census carried out in April-May 2011. Even after the preparation of the Final Electoral Roll, the necessity of a further door-to-door verification was conceded by the Election Commission in para 23 of the above-said CMA, which is reproduced as follows:-- "
23. Voters having different current and permanent address can be re-verified through subsequent door to door verification along with fresh CNIC registrations."
22. It may be observed that Karachi has a peculiar background, which includes a serious law & order situation, detailed stock of the same has been taken by this Court in the case of Watan Party v. Federation of Pakistan (PLD 2011 SC 997). In this judgment categorical directions were made for delimitation, of the constituencies of Karachi in the following terms:-- "Further observe that to avoid political polarization, and to break the cycle of ethnic strife and turf war, boundaries of administrative units like police station, revenue estates, etc. ought to be altered so that the members of different communities may live together in peace and harmony, instead of allowing various groups to claim that particular areas belong to them and declaring certain areas as NO GO Areas under their fearful influence. Subsequent thereto, on similar considerations, in view of relevant laws, delimitation of different constituencies has also to be undertaken with the same object and purpose, particularly to make Karachi, which is the hub of economic and commercial activities and also the face of Pakistan, a peaceful city in the near future. The Election Commission of Pakistan may also initiate the process on its own in this behalf." We believe that so far, the above directions have not been implemented, therefore, Election Commission owes an explanation to this Court. Needless to observe that the above directions were made in the backdrop of the said case and was discussed at length. Another relevant portion from the said judgment is reproduced hereinbelow:-- "
26. It is noteworthy that the law enforcing agencies have detected a torture cell during hearing of the case at Karachi and succeeded in getting video clips of the most heinous, gruesome, brutal, horrible and inhuman acts of the criminals, who are found cutting throats of men and drilling their bodies. But, now it is informed that more such cells have been detected in different parts of Karachi.
27. As far as the injured or wounded persons are concerned, they are countless in number in all the disturbed areas of Karachi where different political parties have got dominant population on the basis of the language being spoken by them. It may be noted that the objective of above-noted brutal and gruesome incidents is to terrorize the citizens of Karachi and keep the entire society a hostage." "
92. An identical situation was prevailing in Malaysia and that Government with full commitment and sincerity had also collected illicit arms from the criminals. Similarly, this task can be completed in our country as well; if there is honest commitment on the part of the law enforcing agencies but in the instant case without depoliticizing the police, positive result apparently seems to be an uphill task, however, to ensure peace in Karachi, certain steps will have to be taken. The law enforcing agencies will have to be de-politicized as well as for recovery of illicit arms effective measures will have to be taken under a proper programme to be launched by the Government. As far as the question of presence of 2.5 million aliens in Karachi is concerned, it is more alarming compared to the activities of the criminals involved in heinous crimes, like target killing, etc. This aspect of the case would reveal that the presence of such persons is not only a factor for increase in crime; but at the same time without proper registration, they are a burden on the national economy, inasmuch as their presence can give rise to so many other administrative problems, including obtaining of National Identity Cards by them. If they have succeeded in this venture and claim themselves to be citizens of Pakistan and have also succeeded in registering their names in the electoral list, it would be tantamount to depriving the actual electorate from choosing their representatives, inasmuch as due to their presence, areas have expanded considerably, which directly affects the delimitation of the constituencies meant for holding elections of the Provincial Assembly and the National Assembly, therefore, the Government should take immediate action against them in accordance with law, namely, the Foreigners Act. NADRA and the Police must undertake a careful cleansing process of such people and NADRA must have separate records and computer files based on proper and cogent evidence. NADRA and police should co-operate in Karachi through an intensive drive to identify foreigners, block their NIC cards after due process of law and special teams should be appointed and dedicated for this job by DG NADRAT and IGP so that this can be completed in the course of next one year or so. Then the law must take it own course in each case. This must be given high priority."
23. The apprehensions of all the petitioners cannot be brushed aside in view of the reasons (directions) quoted above. It is also to be noted that the above judgment is intact as it has not been challenged by filing review petition. Thus a concluded judgment, furnishes strong reasons to hold that in such a situation when there were NO GO Areas, in Karachi; police has been politicized (as per statement of IGP, 30% to 40% of the Principal Law Enforcing Agency, has been politicized); political parties, barring a few have militant groups; life and property of the citizen is not protected; etc., the process of preparing of Electoral Rolls or revising the same transparently was not likely, as alleged by the petitioners. Furthermore, in a situation where life and property of the people is not protected, how electors would come forward to co-operate with the staff of election department for such purpose, and there is every likelihood of illegalities having taken place.
24. Viewed in the above perspective, the discrepancies in the Electoral Roll of Karachi identified by the learned counsel for the petitioners by way of example, examined in conjunction with the admitted position of the Election Commission that a door-to-door verification of the entire residents of Karachi has not been carried out leads to the conclusion that the Electoral Rolls of Karachi do not inspire confidence and the possibility that a significant number of residents of Karachi may have been disenfranchised cannot be ignored. An accurate Electoral Roll is a sine qua non for the holding of a free, fair and transparent election, which is not only the command of the Constitution but also a Fundamental Right of the citizens, which appears to have been compromised qua the residents of Karachi.
25. It may not be out of context to mention that this Court while deciding the case of Workers Party Pakistan (supra) has already highlighted the importance of preparation of the electoral list to ensure free and fair elections and has held as under:-- "
67. Fair, free, honest and just elections are since qua non for strengthening of democracy. To achieve this goal, accurate preparation/revision of electoral roll is immediately required to be undertaken by the Election Commission through credible and independent agencies. In so doing, the convential ways and means of merely depending upon NADRA alone or other similar bodies must be discontinued forthwith. Accordingly, we direct the Election Commission to undertake door-to-door checking of voters lists and complete the process of updating/revision of the electoral rolls by engaging Army and the Frontier Corps, if need....."
26. It may be noted that Article 219 of the Constitution, which is an enabling provision, contemplates an annual revision of Electoral Roll subject to law including the Electoral Rolls Act, 1974 and the Rules framed thereunder. It is an admitted position that the matter of the revision of the Electoral Roll was communicated to this Court by Secretary, Election Commission. The relevant portion of the order dated 4-7-2011 reads as under:-- "Mr. Ishtiaq Ahmed, Secretary Election Commission of Pakistan stated that:- (i) In view of the report of NADRA following categories of unverified voters have been removed from the database of NADRA:-- Category of unverified Voters Voters Count Voters without any Identity Number 15,028,808 Voters with Invalid CNIC 2,140,015 Voters with Duplicate CNIC entries 2,491,090 Voters with Duplicate MNIC entries 6,469,310 Voters with MNIC not registered with NADRA 11,056,775 Total unverified Voters: 37,185,998 (ii) In the place of above removed voters, 36 million voters have been entered into the database and verification of both the categories is to be carried out by visiting/approaching the house of each voter by the representative of the Election Commission door to door. This exercise shall commence from 18th of July, 2011 and is likely to be completed on 16th of August, 2011. He added that further procedure of publishing/displaying these lists shall be carried out according to law and in this respect, a comprehensive plan has already been chalked out, copy of which has been placed on record. According to him, the whole procedure is likely to be completed by 16th of December, 2011 and thereafter the lists shall be handed over to NADRA for scanning and printing." This process was undertaken in the month of May, 2011 but the final notification has been issued in May, 2012. Thus, we have to refer to the meaning of Annual, which could mean, after one year or during a year, from time to time. For reference the meaning and definition of "annual" is given below:-- Annual Meaning and Definition The World Book/Dictionary, Volume One (1) Coming once a year: Your Birthday is an annual event. (2) In a year; for a year: What is his annual salary? (3) Lasting for a whole year; accomplished during a year: The earth makes an annual course around the sun. (4) Living but one year or season: Corn and beans are annual plants. The Major Law Lexicon Pertaining or relating to a year; yearly; as the annual growth of a tree; annual profits; annual rents; relating to the events or transactions of a year; as, an annual report. A Mass for a deceased person or for some special object, said daily for a year or on the anniversary day. (3) (a.) (3) A Mass for a deceased person or for some special object, said daily for a year or on the anniversary day. In the case of National Insurance Company v. Life Insurance Corporation (AIR 1963 SC 1171) it has been held that the word "annual" must be given its full meaning. By the word "annual" is meant something which is reckoned by the year. In the case of Prem Kevalram Shahani v. Government of Pakistan (PLD 1989 Karachi 123) it has been held that a plain reading, of Article 218 shows that its clauses (1) and (2) provide the constitution of the Commission and its composition, whereas clause (3) provides its duties, namely, that it shall be the duty of the Election Commission in relation to an election to organize and conduct the election and to make such arrangements as are necessary to ensure that the election is conducted honestly, justly, fairly and in accordance with law, and that corrupt practices are guarded against, whereas Article 219 lays down the duties of the Commission, namely, preparing electoral rolls for election to the National Assembly and the Provincial Assemblies and revising such rolls annually, organizing and conducting election to the Senate or to fill casual vacancies in a House or a Provincial Assembly and appointing Election Tribunals. There can be no escape from the fact that a free, fair, just and transparent election is the very heart of our democratic system, as envisaged by the Constitution. Such elections must not only be held in a fair, just and honest manner but also appear to be so; in order to inspire the confidence of the electorate. The provisions of Article 219 of the Constitution and the Electoral Rolls Act, 1974 and rules framed thereunder must necessarily be interpreted in manner so as to achieve the said object. Consequently, Election Commission must fulfill its obligation cast upon it by Article 218 of the Constitution of ensuring the holding free, fair and transparent elections and to achieve such purpose seek assistance, if necessary from the Executive Authorities in the Federation in this behalf which are obliged to render such assistance by virtue of Article 220 of the Constitution.
27. There is no denial of the fact that free, fair, honest, transparent and just election is demand of the day as the Parliamentary system of the country is strengthening day by day. Therefore, all eligible citizens have a fundamental right of franchise, which must be protected by issuing appropriate directions.
28. In the above circumstances, it is clear that the Electoral Rolls of the city of Karachi are required to be revised by the Election Commission in exercise of powers conferred upon it under Article 219 of the Constitution read with Electoral Rolls Act, 1974 to achieve the object, which is to be ensured by the Commission in terms of Article 218 of the Constitution. Thus, the Election Commission of Pakistan is directed to carry out proper and complete door-to-door verification in Karachi so as to ensure that no voter is disenfranchised or dislocated and all other discrepancies are rectified as early as possible. In view of the peculiar security situation in Karachi highlighted hereinabove such verification must be carried out by the Election Commission with the help and assistance of Pakistan Army and the FC.
29. For the foregoing reasons, Constitution Petitions Nos.45 of 2007 and 111 and 123 of 2012 are disposed of in the above terms. Constitution Petition No.31 of 2011 is adjourned to a date in office. فیصلہ شیخ عظمت سعید، جج
اسلامیہ جمہوریہ پاکستان کے آئین مجریہ 1973 ء کے تحت پاکستان میں پارلیمانی طرز حکومت موجود ہے۔ جس کے تحت وفاق کے لئے پارلیمنٹ جو کے قومی اسمبلی اور سینٹ پر مشتمل ہے اور صوبوں کے لئے صوبائی اسمبلیاں موجود ہیں۔ عوام پر ان کے منتخب نمائندے حکومت کرتے ہیں جو آئین کے آرٹیکل 17 کے تحت ضامن بنیادی حقوق کے نفاذ کو لازم بناتے ہیں۔ متعلقہ آرٹیکل کو یہاں بیان کرنا مفید ہو گا۔ تنظیم کی آزادی: 1۔ ہر شہری کو چند قانونی پابندیوں کو ملحوظِ خاطر رکھتے ہوئے جو کہ پاکستان کی سلامتی، عوامی استحکام اور اخلاقی طور پر حق بجانب ہوں تنظیم/یونین سازی کا حق حاصل ہے۔ 2۔ ہر شہری جو کہ حکومتِ پاکستان کی ملازمت میں نہیں ہیں کو حق حاصل ہے کہ چند قانونی پابندیوں کو ملحوظِ خاطر رکھتے ہوئے جو کہ پاکستان کی سلامتی، عوامی استحکام اور اخلاقی اقدار کا خیال رکھتے ہوئے، کوئی سیاسی جماعت قائم کریں یا ان کا رکن بنیں اور قانون میں یہ بیان ہو کہ وفاقی حکومت اگر کسی سیاسی جماعت کے بارے میں یہ اعلان کرتی ہے کہ اُس کے قیام پاکستان کی سلامتی کے لئے نقصان دہ ہے تو وفاقی حکومت اُس علان کے پندرہ دنوں کے اندر یہ معاملہ عدالتِ عظمیٰ کو بھیجے گی جس کا فیصلہ اس معاملے میں حتمی ہو گا۔ 3۔ ہر سیاسی جماعت پر لازم ہے کہ وہ سرمائے کے حصول کے ذرائع کو قانون کے مطابق واضح کرے۔ 2۔ مختلف رائج قوانین کے تحت عوام کی جانب سے اپنے منتخب نمائندوں کے چناؤ میں مدد کے لئے ایک مربوط طریقہ کار موجود ہے جس کی بناء پر عوام آئین اور قانون کے مطابق اپنے نمائندے منتخب کرتے ہیں ان قوانین میں آئین کے آرٹیکل 218 اور 219 کے علاوہ انتخابی فہرستوں کا قانون مجریہ 1974ء (Electroal Roll Act 1974) بھی شامل ہیں۔ آئین کے آرٹیکل 218(3) کے تحت یہ الیکشن کمیشن آف پاکستان کی ذمہ داری ہے کہ وہ انتخابات کے انعقاد کا طریقہ کار مقرر کرے۔ اور انتخاب چاہے ضمنی ہو یا عام اُن کے قانون کے مطابق منصفانہ انعقاد کے لئے ضروری اقدامات کرے۔ جب کے آئین کے آرٹیکل 219 کے تحت الیکشن کمیشن آف پاکستان کے فرائض میں یہ بھی شامل ہے کہ وہ انتخابی فہرستیں تیار کرے اور مختلف معیادی مدتوں میں حالات کے مطابق اُن کی نظر ثانی کرے تاکہ تمام اہل ووٹرز کو اپنا حقِ رائے دہی استعمال کرنے کے قابل بنایا جا سکے۔ 3۔ یہ بات قابلِ ذکر ہے کہ آئینی درخواست نمبر 45/2007 محترمہ بے نظیر بھٹو مرحومہ کی جانب سے آئین کے آرٹیکل نمبر 184/3 کے تحت دائر کی گئی تھی جس میں استدعار کی گئی تھی کی مسؤل الیہان (الیکشن کمیشن آف پاکستان و دیگران) کو ہدایت جاری کی جائیں کہ وہ ووٹرز کا اندارج کمپیوٹرائزڈ/الیکٹرانک فہرستوں کے ذریعے کرے۔ تاکہ آئین کے آرٹیکل 51/2 کے تحت تمام افراد جو ووٹ ڈالنے کے اہل ہیں کا اندراج یقینی بنایا جا سکے۔ اور کمپیوٹرائزڈ شناختی کارڈ کے ذریعے اہل ووٹرز کی رجسٹریشن کو غیر قانونی اور غیر موثر قرار دیا جائے۔ مذکورہ درخواست مورخہ 10-8-2007 کو عدالتِ ہذا کے روبرو سماعت کے لئے پیش کی گئی جس میں ایک حکم جاری کیا گیا جس کا متعلقہ حصہ بغرضِ آسانی درج ذیل ہے:۔ 2۔ یہ بات قابل غور ہے کہ الیکشن کمیشن نے پیرا وائز جواب داخل کیا جس میں 2006 - 2007 ء کی کمپیوٹرائزڈ انتخابی فہرستوں میں اضافی اندراجات کے لئے شیڈول مہیا کیا جس کے مطابق 3 اگست 2007 ء سے یہ عمل شروع ہو گا اور 20 دسمبر 2007ء کو ختم ہو گا۔ اس تمام عمل کو مکمل ہونے میں 140 دن لگیں گے۔ ہم نے مذکورہ شیڈول/گوشوارے کا بغور جائزہ لیا۔ ان اندراجات کو مکمل کرنے کے لئے جو دورانیہ دیا گیا ہے وہ بہت زیادہ ہے ہمارا خیال ہے کہ یہ کارروائی کم سے کم مدت میں مکمل کی جا سکتی ہے۔ کیونکہ معاملہ بہت سادہ ہے اور دوسری جانب 2002 ء کے انتخابات میں تیار کردہ ووٹرز کی انتخابی فہرستیں موجود ہیں جن کے مطابق 71.86 ملین ووٹرز موجود ہیں۔ جب کہ ووٹرز کی فہرستیں جو کہ حالیہ طور پر تیار کی گئی ہیں کے مطابق رجسٹرڈ ووٹرز کی تعداد 5,21,02,428 ہے۔ جس سے اندازاً دو کروڑ رجسٹرڈ ووٹرز کا فرق ظاہر کرتا ہے۔ لہٰذا الیکشن کمیشن پہلے سے تیار شدہ انتخابی فہرستوں کا جائزہ لیتے ہوئے صرف ان اندراجات کے درست اور حقیقی ہونے کی تصدیق کرے۔ اور بقایا اندراجات کے حصول کے لئے الیکشن کمیشن ان افراد کو جن کے نام اصل فہرستوں میں شامل ہونے سے رہ گئے ہیں یا ابھی تک اُن کا اندراج ہی نہیں کیا گیا کو فارم وغیرہ تقسیم کر کے معلومات حاصل کر سکتی ہے۔ فارم کی تقسیم کا یہ کام ڈاک خانے یا کسی اور ذریعے کے تحت کم از کم وقت میں مکمل کیا جا سکتا ہے۔ جس کے لئے اگر ملازمین کی تعداد دو گنا یا تین گنا بھی کرنا پڑے تو بھی یہ کام تیس دن میں مکمل ہو سکتا ہے۔ تاہم اس تمام عمل میں الیکشن کمیشن کی جانب سے مزید بہتری لائی جا سکتی ہے۔ اگر موجودہ فہرستوں میں صرف باقی رہ جانے والے ووٹرز کا اندراج کم سے کم مدت میں کر لیا جائے تو اس عمل سے آنے والے انتخابات کے صاف اور شفاف انعقاد میں مدد ملے گی ۔ 4۔ مقدمے کی سماعت مذکورہ تاریخ کے بعد 4-10-2007 کو دوبارہ ہوئی تھی جب الیکشن کمیشن آف پاکستان کے نمائندے نے عدالت میں بیان کیا کہ عدالت کی جانب سے جاری کردہ ہدایات کی روشنی میں مذکورہ کارروائی عمل میں لائی گئی اور انتخابی فہرستوں میں تقریباً 27 ملین ووٹرز کا مزید اندراج کیا گیا یہ مزید بیان کیا گیا کہ تقریباً 80 ملین افراد ہیں جو کہ حقِ رائے دہی استعمال کرنے کے اہل ہیں۔ لیکن الیکشن کمیشن کو ان فہرستوں کو قواعد کے مطابق چھپوانے اور شائع کروانے کے لئے کچھ مزید وقت درکار ہے۔ لہٰذا الیکشن کمیشن کو ہدایات جاری کی گئیں کہ مذکورہ فہرستوں کی اشاعت مورخہ 25-10-2007 تک مکمل کر کے فہرست کو الیکشن کمیشن کی ویب سائٹ پر آوایزاں کیا جائے۔ 5۔ مورخہ 7-4-2011 کو جناب عمران خان، چیئرمین پاکستان تحریک انصاف نے آئینی درخواست نمبر 31/2011 دائر کی جس میں منجملہ اور چیزوں کے استدعا کی گئی کہ الیکشن کمیشن آف پاکستان کو ہدایات جاری کی جائیں کہ وہ تمام جعلی ووٹوں کے اندراجات کو حذف کرتے ہوئے نئی فہرستیں تیار کرے اور اہل ووٹر کے اندراجات کرے۔ جو کہ نادرا کے ریکارڈ سے تصدیق کئے جا سکیں۔ اور ووٹرز کے ووٹ ان کے قومی شناختی کارڈ میں موجود پتے کے تحت درج کئے جائیں۔ درخواست کی سماعت مختلف اوقات میں کی گئی اور ضروری احکامات بھی جاری کئے گئے مورخہ 4-7-2011 کو سیکرٹری الیکشن کمیشن عدالت کے روبرو پیش ہوئے اور بیان کیا کہ ایک سوالنامہ تیار کیا گیا ہے جس میں ووٹرز کو اجازت دی گئی ہے کہ وہ اپنے ووٹ کا اندراج شناختی کارڈ میں درج مستقل جائے رہائش پر یا عارضی رہائشی پتے جہاں پر وہ برائے روز گار یا کسی اور وجہ سے رہ رہا ہے کے تحت کروا سکے اور اس کی جانب سے منتخب کردہ طریقہ کار ووٹرز کی فہرست میں شائع بھی کیا جائے گا۔ 6۔ اسی دوران ورکرز پارٹی پاکستان نے آئینی درخواست نمبر 87/2011 دائر کی جس میں منجملہ اور چیزوں کے استدعا کی گئی تھی کہ موجودہ انتخابی طریقہ کار جس میں پیسہ، طاقت اور اثر و رسوخ استعمال کیا جاتا ہے۔ آئین کی اصل روح جو کہ آزاد، شفاف اور منصفانہ انتخابات پر زور دیتی ہے کے منافی ہیں۔ اور جس کا مداوا کیا جانا لازمی ہے۔ مذکورہ درخواست کو شائع شدہ فیصلہ ورکرز پارٹی پاکستان بنام وفاقِ پاکستان (PLD 2012 SC 681) کے تحت نمٹا دیا گیا جس میں مندرجہ ذیل ہدایات جاری کی گئیں۔ (j)۔ صاف شفاف اور منصفانہ انتخابات کے مقاصد کے حصول کے لئے ضروری ہے کہ نئی انتخابی فہرستیں الیکشن کمیشن کی جانب سے مصدقہ معلومات کے تحت اور خود مختار اداروں کے ذریعے مکمل کی جائیں۔ لہٰذا ہم الیکشن کمیشن کو ہدایت کرتے ہیں کہ وہ گھر گھر جا کر انتخابی فہرستوں کی تکمیل کا کام مکمل کرے اور چاہے تو اس مقصد کے لئے اور شفافیت کو یقینی بنانے کے لئے آرمی یا فرنٹیئر افواج کی مدد بھی حاصل کر لے ۔ 7۔ بعد ازاں سید منور حسن، امیر جماعت اسلامی اور دیگر دو افراد کی جانب سے آئینی درخواست نمبر 111/2012 دائر کی گئی جس میں منجملہ اور چیزوں کے استدعا کی گئی کہ انتخابی فہرستیں جو کہ الیکشن کمیشن آف پاکستان کی جانب سے تیار کردہ ہیں ان میں صوبہ سندھ کے اندرجات میں بے بحا غلطیاں اور بے قاعدگیاں موجود ہیں۔ خاص طور پر کراچی کے اندراج کو غیر قانونی قرار دیا جانا چاہیے اور مسؤل الیہان کو ہدایات کی جانی چاہیے کہ وہ نئی انتخابی فہرستیں تیار کریں اور مذکورہ اغلاط کو ووٹرز کے موجود پتوں اور شہروں جن میں وہ رہتے ہیں کہ بنیادوں پر درست کیا جائے۔ جناب سلیم ضیاء سیکرٹری جنرل پاکستان مسلم لیگ ن سندھ نے بھی ایک آئینی درخواست نمبر 123/2012 اسی طرح کی استدعا کے ساتھ دائر کی۔ مورخہ 22-11-2012 کو ڈاکٹر فروغ نسیم، فاضل ایڈووکیٹ سپریم کورٹ نے ایک C.M.A. No.4840/2012 ، متحدہ قومی موومنٹ کی جانب سے داخل کی۔ جس میں استدعا کی گئی کہ متحدہ قومی موومنٹ کو مذکورہ آئینی درخواست میں بطور مسؤل الیہ شامل کیا جائے اور انہیں بھی متاثرہ فریق کے طور پر سُنا جائے۔ ان کی یہ استدعا اُسی دن منظور ہو گئی اور مذکورہ تمام معاملات کی سماعت ایک ساتھ کی گئی۔ 8۔ عدالت نے حامد خان، رشید اے رضوی، ڈاکٹر محمد شمیم رانا، ڈاکٹر فروغ نسیم، سردار خرم لطیف خاں کھوسہ، محمد منیر پراچہ جو کہ فریقین کے فاضل وکلاء تھے اور جناب دل محمد علیزئی، فاضل ڈپٹی اٹارنی کو سنا۔ 9۔ درخواست گزاران کے فاضل وکلاء کی جانب سے اُٹھایا گیا اصل مدعا یہ تھا کہ عدالتِ ہذا کے مقدمہ ورکرز پارٹی پاکستان میں دئیے جانے والے فیصلے پر الیکشن کمیشن آف پاکستان نے اس فیصلے کی اصل روح کے مطابق عمل درآمد نہیں کیا۔ جب کہ کراچی میں انتخابی فہرستوں میں اندراج کی واضح بے قاعدگیاں اور غلطیاں موجود ہیں جن کی وجہ سے بہت سے افراد اپنا حقِ رائے دہی استعمال کرنے سے محروم رہ جائیں گے چونکہ ان کے نام انتخابی فہرستوں میں سے حذف کر دئے گئے ہیں۔ مندرجہ بالا تحفظات کے جواب میں الیکشن کمیشن کی جانب سے قدرے حیلہ جو جواب داخل کیا گیا جو کہ ریکارڈ پر موجود مواد کی موجودگی میں حوصلہ افزاء نہ تھا جس میں انتخابی فہرستوں کا ایک تقابلی جائزہ بھی موجود تھا جس کی روح سے یہ ظاہر ہوتا تھا کہ مکان نمبر E-43, PECHS, Block 2, Karachi جو کہ 120 Sq. Yards پر تعمیر شدہ ہے، میں صرف 663 ووٹرز کا اندراج موجود ہے۔ جناب ایم شمیم رانا، ایڈووکیٹ سپریم کورٹ نے بیان دیا کہ بہت سے ووٹرز کے نام کراچی کی انتخابی فہرستوں سے حذف کر دئیے گئے ہیں اور ملک کے دوسرے حصوں میں ناجائز طریقے سے منتقل کر دئیے گئے ہیں جن میں خود اُن کو اپنا ووٹ بھی شامل ہے۔ اپنے الزامات کے جواز میں انہوں نے C.M.A. No.4830/2012 کے تحت دائر کردہ متعلقہ مواد کا حوالہ دیا۔ جناب حامد خان، سینئر ایڈووکیٹ سپریم کورٹ نے بیان کیا کہ باوثوق ذرائع سے معلوم ہوا ہے کہ ووٹرز کی فہرستوں کو دوبارہ تیار کرتے ہوئے جو کہ سیکرٹری الیکشن کمیشن آف پاکستان کے مورخہ 4-7-2011 کو کئے گئے وعدے کے مطابق تھیں صرف دس فیصد ووٹرز کا اندراج ممکن ہوا ہے۔ درخواست گزاران کے فاضل وکیل نے مزید الزام لگایا کہ کراچی شہر کے تقریباً پچاس فیصد ووٹوں کو ملک کے دیگر حصوں میں منتقل کیا گیا ہے اور ان کی جگہ پر غیر تصدیق شدہ ووٹرز کا اندراج کیا گیا ہے جس سے ظاہر ہوتا ہے کہ متوقع انتخابات میں دھاندلی کی تیاری کی گئی ہے جس کے نتیجے میں عوام کو حاصل بنیادی حقِ رائے دہی کے حق جو کہ آئین کے اصولوں کے تحت اصل اور جائز ووٹروں کو حاصل ہے جن کے نام پچھلے دو تہائی عام انتخابات اور ضمنی انتخابات میں تصدیق شدہ تھے سے محروم رکھا جائے گا اور جس سے صاف شفاف اور آزادانہ انتخابات کا مقصد ناکام ہو جاتا ہے۔ تاوقتیکہ ووٹرز کے ناموں کے اندراجات کا دوبارہ جائزہ لیا جائے اور قانون اور آئین کے مطابق اُن کے قومی شناختی کارڈز کے ذریعے گھر گھر جا کر اندراجات کی تصدیق کی جائے۔ 11۔ سردار خرم لطیف کھوسہ جو کہ آئینی درخواست نمبر 45/2007 میں فاضل وکیل ہیں نے مماثل شکایت کا اعادہ کرتے ہوئے محترمہ بے نظیر بھٹو مرحومہ جو کہ اس وقت پاکستان پیپلز پارٹی کی چیئرپرسن تھیں کی درخواست جو کہ آئین کے آرٹیکل 184/3 کے تحت دائر کردہ تھی اور جس کے مدعی اب جناب جہانگیر بدر تھے میں اٹھائے گئے سوالات کو اجاگر کیا۔ انہوں نے جناب جہانگیر بدر، سیکرٹری جنرل پاکستان پیپلز پارٹی کے تحفظات جو کہ انہوں نے عدالت کے روبرو مورخہ 21-11-2012 کی اپنی پیشی کے دوران ظاہر کئے تھے کا حوالہ دیا جس کے مطابق کراچی کی انتخابی فہرستیں جو کہ الیکشن کمیشن آف پاکستان کی جانب سے تیار کردہ ہیں میں شدید نوعیت کی غلطیاں اور بے ضابطگیاں موجود ہیں جن کی تصحیح کی جانی ناگزیر ہے۔ یہی استدعا دیگر درخواست گزاران کے وکلاء نے کی ہے۔ انہوں نے آئینی درخواست نمبر 45/2007 میں عدالت ہذا کے حکم مورخہ 16-8-2007 (جس کا حوالہ اوپر دیا جا چکا ہے) کا حوالہ بھی دیا جس میں الیکشن کمیشن آف پاکستان کو مطلوبہ کارروائی حکم مورخہ 10-8-2007 کے تحفظات کی رو سے تیس روز کے دوران مکمل کرنے کا حکم دیا گیا تھا۔ 12۔ ڈاکٹر فروغ نسیم، فاضل وکیل بجانب ایم کیو ایم نے دوسری جانب یہ اعتراض کیا کہ کراچی میں انتخابی فہرستوں کی تیاری کا کام مکمل کیا جا چکا ہے۔ اور جب تک انتخابات کی تاریخوں کا اعلان کیا جائے گا ان اندراجات کی تصدیق صرف انفرادی ووٹرز کی خواہش پر کی جا سکتی ہے نہ کہ کسی سیاسی جماعت کے ایماء پر اور انتخابی فہرستوں کی دوبارہ تیاری کا کوئی جواز نہیں اور نہ ہی یہ جائز ہو گا۔ اس کے لئے انہوں نے مقدمات لکشمی چرن سین اور دیگران بنام اے کے ایم حسن عظمان اور دیگران (AIR 985 SC 1233) اور سی لکشمی نارائن بنام چیف الیکشن کمیشن (AIR 1997 Madras 125) کا حوالہ دیا۔ 13۔ دوسری جانب سے جناب منیر پراچہ فاضل وکیل بجانب الیکشن کمیشن نے مزید بیان کیا کہ کراچی میں انتخابی فہرستوں کی تیاری کا کام مکمل کر لیا گیا ہے۔ اور الیکشن کمیشن نے اپنا جواب دائر کر دیا ہے جس میں الیکشن کمیشن نے اپنا کردار واضح کیا ہے انہوں نے مزید بیان کیا کہ کراچی کی انتخابی فہرستوں کی سالانہ نظر ثانی اس موقع پر ممکن نہیں اور نہ ہی قانون اس کی اجازت دیتا ہے اور یہ نظر ثانی اب صرف اگلے سال ہی ممکن ہو گی۔ کیونکہ قانون کے تحت انتخابی فہرستوں کی نظر ثانی سالانہ بنیادوں پر لازم ہے۔ تاہم انہوں نے یقین دلایا کہ انفرادی شکایات اگر قانونی طور پر اٹھائی جاتی ہیں تو ان کی تلافی اگلے انتخابات کے اعلان تک ممکن ہے جناب دل محمد علی زئی فاضل ڈپٹی ایڈووکیٹ جنرل نے جناب محمد منیر پراچہ، فاضل ایڈووکیٹ سپریم کورٹ کی بحث سے اتفاق کیا۔ 14۔ سب سے پہلے ہم ڈاکغر فروغ نسیم، فاضل وکیل بجانب ایم کیو ایم کی جانب سے اٹھائے جانے والے اعتراض کا جائزہ لیتے ہیں کہ درخواست گزاران کی جانب سے لگائے جانے والے الزامات انفرادی ہیں جن کی چارہ جوئی کے لئے طریقہ کار انتخابی فہرستوں کے قانون مجریہ 1974ء اور مذکورہ قانون کے تحت تیار کردہ کوائف میں دیا گیا ہے۔ اور درخواست گزار سیاسی جماعتوں کے پاس ان معاملات کو مذکورہ کارروائیوں کے تحت اٹھانے کے لئے کوئی قانونی جواز نہیں۔ موجودہ مقدمے میں آئین کا آرٹیکل 184(3) کا سہارا لیا گیا ہے جو کہ یہ ظاہر کرتا ہے کہ وقت کے ساتھ ساتھ عدالتِ ہذا کو آئین کے آرٹیکل 184(3) کے تحت حاصل دائرہ اختیار میں تبدیلی آئی ہے اور اس کو مزید وسعت ملی ہے جو عدالتِ ہذا کی جانب سے جاری کردہ فیصلوں سے ثابت شدہ ہے۔ یہ واضح کیا جا چکا ہے کہ آئین کے آرٹیکل 184(3) کے تحت کی جانے والی کارروائی کسی انفرادی شکایت کی چارہ جوئی تک محدود نہیں اسی طرح قانونی جواز کا اصول اُن مقدمات پر لاگو نہیں ہوتا جہاں پر عوامی اہمیت کے معاملات بنیادی حقوق کے نفاذ کے لئے اُٹھائے جائیں بطورِ خاص وہ مقدمات جو کہ عوامی مفاد کے زمرے میں آتے ہیں اور جن کا مقصد تمام شہریوں کو قانون کی حکمرانی کے ذریعے تحفظ فراہم کرنا ہوتا ہے جو کہ مقدمات محترمہ بے نظیر بھٹو بنام فیڈریشن آف پاکستان اور دیگر (PLD 1988 SC 416) میاں محمد نواز شریف بنام صدرِ پاکستان و دیگر (PLD 1993 SC 473) ڈاکٹر اختر حسن خان اور دیگران بنام وفاقِ پاکستان اور دیگر (2012 SCMR 455) اور محمد یسین بنام وفاقِ پاکستان بذریعہ سیکرٹری اسٹیبلشمنٹ ڈویژن اسلام آباد اور دیگران (PLD 2012 SC 132) میں بھی اسی اصول کی تشریح کی گئی ہے۔ 15۔ جہاں تک کہ موجودہ درخواست کے آئین کے آرٹیکل 184(3) کے تحت قابلِ سماعت ہونے اور انتخابات کے انعقاد کے معاملے کا جائزہ لینے کے اعتراض کا تعلق ہے اور سیاسی پارٹیوں کے حقوق کے وہ آئین اور قانون کے مطابق انتخابات میں حصہ لے سکیں کا تعلق ہے۔ عدالتِ ہذا کے مقدمہ ورکرز پارٹی جو کے اوپر بیان کردہ ہے کے فیصلے سے عیاں ہے جس میں ایسے بیان کیا گیا 33۔ آئین کے آرٹیکل 184(3) کے تحت عدالتِ ہذا کا اختیار بے شمار نظائر سے واضح شدہ ہے۔ لہٰذا ان آئینی شقات کی تشریح دوبارہ کرنے اور تمام نظائر کا دوبارہ حوالہ دینے کی تاکہ اختیار سماعت کے سوال کا فصیلہ کیا جا سکے، موجودہ مقدموں میں کوئی ضرورت نہیں۔ اس عدالت نے مقدمات محترمہ بے نظیر بھٹو بنام وفاقِ پاکستان (PLD 1988 SC 416) حاجی محمد سیف اللہ خان بنام وفاقِ پاکستان (PLD 1989 SC 166) اور محمد نواز شریف بنام صدرِ پاکستان (PLD 1993 SC 473) میں پہلے یہ فیصلہ دیا جا چکا ہے کہ آئین کے آرٹیکل سترہ کے تحت کسی سیاسی جماعت کا قیام اور اس کا رکن بننے کا حق میں انتخابات میں شمولیت اور حصہ لینے کا حق اور کامیابی کی صورت میں حکومت سازی کا حق بھی شامل ہے۔ درخواست گزارنے پُر زور طریقے سے اجتجاج کیا کہ مجوزہ کارروائی آئین کے آرٹیکل سترہ اور آرٹیکل 25 کے تحت ضمانت یافتہ بنیادی حقوق کی کھلی خلاف ورزی ہے۔ مسؤل الیہان میں سے کسی نے بھی درخواست گزار کے مذکورہ تحفظات کو نہیں جھٹلایا۔ لہٰذا موجودہ درخواست کو قابلِ سماعت قرار دیا جاتا ہے۔ 34۔ یہاں یہ بات قابلِ ذکر ہے کہ موجودہ درخواست مفادِ عام کی مقدمات سے متعلق ہے جو کہ مخالفتی نہیں بلکہ تحقیقاتی نوعیت کی ہوتی ہیں۔ مقدمات وطن پارٹی بنام وفاقِ پاکستان (PLD 2011 SC 997) اور All Pakistan Newspapers Society v. Federation of Pakistan، (PLD 2012 SC 1) جن کا حوالہ فروغ نسیم، ایڈووکیٹ سپریم کورٹ نے دیا میں اس عدالت نے فیصلہ کیا تھا کہ عدالت کو اُن مقدمات کی سماعت کا اکتیار حاصل ہے جو کہ اس عدالت کے تحقیقی دائرہ اختیار میں آتے ہیں۔ یہ بھی طے شدہ ہے کہ آئین کے آرٹیکل 184(3) کے تحت دائر کردہ درخواست کی سماعت کرتے ہوئے عدالتِ ہذا کو قوانین اور قواعد و ضوابط کا جائزہ لینے کا مکمل اختیار حاصل ہے۔ جس کے لئے مقدمات وکلاء محاذ برائے تحفظِ دستور بنام وفاقِ پاکستان (PLD 1988 SC 1263) فاروق احمد خان لغاری بنام وفاقِ پاکستان (PLD 1999 SC 57) جلال محمود شاہ بنام وفاقِ پاکستان (PLD 1999 SC 395) لیاقت حسین بنام وفاقِ پاکستان (PLD 1999 SC 504) مبشر حسن بنام وفاقِ پاکستان (PLD 20120 SC 265) اور محمد مبین السلام بنام وفاقِ پاکستان (PLD 2006 SC 602) کا حوالہ دیا جاتا ہے۔ اس معاملے میں عدالتِ ہذا کے شائع شدہ مقدمہ مبشر لقمان بنام فیڈریشن آف پاکستان اور دیگران (PLD 2011 SC 775) کا حوالہ بھی ضروری ہے۔ پس مذکورہ بالا مقدمات میں طے کردہ قوانین کی روشنی میں یہ ظاہر ہے کہ عدالتِ ہذا آئین کے آرٹیکل 184(3) کے تحت ناصرف عوامی اہمیت کے مقدمات جن میں بنیادی حقوق کے نفاذ کا سوال ہو کا فیصلہ کرنے کا اختیار رکتھی ہے بلکہ آئین کے تحت صاف شفاف اور منصفانہ انتخابات کے انعقاد کے لئے ضروری اقدامات کو یقینی بنانے کا اختیار بھی رکھتی ہے۔ لہٰذا ان درخواستوں کو قابلِ سماعت قرار دیا جاتا ہے اور ان میں اٹھائی گئی شکایات کو موجودہ کارروائیوں کے تحت قرار دیا جاتا ہے۔ ڈاکٹر فروغ نسیم فاضل ایڈووکیٹ سپریم کورٹ کی جانب سے اٹھایا گیا اعتراض ظاہری طور پر غلط فہمی پر مبنی ہیں اور جن مقدمات پر انہوں نے انحصار کیا وہ موجودہ کارروائی سے غیر متعلقہ ہیں۔ 16۔ ہم نے فریقین کے وکلاء کی جانب سے بیان کردہ گزارشات کا قانون کے مطابق جائزہ لیا اور ہمارے سامنے پیش کردہ مواد کا مشاہدہ کیا اور ساتھ ہی ان قوانین کا جائزہ لیا جن کا حوالہ انہوں نے دورانِ سماعت پیش کیا۔ 17۔ آئین کے آرٹیکل 218(3) کے تحت یہ حکم ہے کہ الیکشن کمیشن آف پاکستان کی ذمہ داری ہے کہ وہ ملک میں ضمنی اور عام انتخابات کے صاف شفاف اور آزادانہ انعقاد کو یقینی بنائے۔ جب کہ آئین کے آرٹیکل 219 کے تحت الیکشن کمیشن آف پاکستان کو یہ حکم بھی دیا گیا ہے کہ وہ انتخابی فہرستوں کی سالانہ نظر ثانی کرے۔ جس کا مقصد صاف شفاف انتخابات کے انعقاد کے علاوہ اور کچھ نہیں۔ 18۔ مقدمے کی قانونی تفصیل میں جانے سے پہلے ہمارے خیال میں گزٹ آف پاکستان جون 2002 کے مطابق کراچی ڈویژن کی قومی اور صوبائی اسمبلی کی حلقہ بندیوں کو یہاں دوبارہ پیش کرنا مناسب ہے۔ جہاں سے آئینی طریقہ کار کے مطابق منتخب کنندگان کو اپنے نمائندوں کا انتخاب کرنا مطلوب ہے۔ کراچی ڈویژن قومی حلقہ انتخاب کا نام اور نمبر این اے 239 کراچیI- تا این اے 258 کراچی XX - (20 سیٹیں) صوبائی حلقہ انتخاب کا نام اور نمبر پی ایس 89 کراچی I - تا پی ایس 130 کراچی XLII - (42 سیٹیں) یہ نوٹ کرنا بھی اتنا ہی اہم ہے کہ کراچی میں درج ذیل ووٹرز کی تعداد انتخابی فہرست سال 2012 پر لائی گئی ہے۔ نام ضلع مرد خواتین مخنث کل تعداد کراچی سنٹرل 897443 712916 5 1610634 کراچی ایسٹ 1129217 901466 6 2030689 کراچی ساؤتھ 603258 464342 3 1067603 کراچی ویسٹ 856085 560314 12 1416411 ملیر 426562 300314 5 726881 کل تعداد 3912565 2939352 31 6851948 19۔ الیکشن کمیشن آف پاکستان نے بحوالہ سی ایم اے نمبر 4654/2012 ایک جواب داخل کیا ہے جس میں اس نے تسلیم کیا ہے کہ انتخابی فہرست کی نظر ثانی کا عمل اپریل، مئی 2011 کے ماہ سے متعلق ہے۔ مذکورہ جواب کا عکس ذیل میں دوبارہ پیش کیا جاتا ہے:۔ 8۔ مذکورہ بالا وجوہات نے ای سی پی اور نادرا کو مجبور کیا کہ نئے شماریاتی بلاکس کے مطابق پتہ جات کے لحاظ سے اپنا دیٹا بیس درست کریں۔ اس مقصد کے لئے نئے بنائے گئے شماریاتی بلاکس کے ساتھ خاندانوں کا موجودہ محلِ وقوع سے تعلق معلوم کرنے کے لئے ایک سوالنامہ تیار کیا گیا۔ یہ سوالنامہ شمار کنندگان کی جانب سے اپریل، مئی 2011 مٰں ہونے والی خانہ شماری کے دوران پُر کئے گئے۔ 20۔ ان آئینی درخواستوں کے ذریعے کراچی کے حوالے سے اُٹھائے جانے والے معاملے کو مذکورہ بالا پس منظر کی روشنی میں دیکھنا ضروری ہے۔ الیکشن کمیشن آف پاکستان کا مدعا یہ ہے کہ کراچی میں 82% میں آبادی کی گھر گھر تصدیق ہو چکی ہے۔ سائل کے فاضل وکیل نے اس دعویٰ کی تردید کرتے ہوئے کہا کہ کراچی میں کوئی گھر گھر تصدیق نہیں کی گئی اور یہ حقیقت ان پیچیدگیوں سے بھی عیاں ہے کہ 120 گز کے گھر میں 600 ورٹرز کا اندراج ہے جن کو کہ ایک ہی گھر کا مکین ظاہر کیا گیا ہے۔ 21۔ گھر شماری کی انتخابی فہرست اپریل، مئی 2011 میں کرائی گئی، انتخابی فہرست کی حتمی تیاری کے بعد الیکشن کمیشن نے گھر گھر تصدیق کی ضرورت کو محسوس کیا۔ مذکورہ بالا متفرق درخواست کے پیرا 23 جو کہ درج ذیل ہے۔ 23۔ عارضی اور مستقل مختلف پتہ کے حامل ووٹرز کی دوابرہ گھر گھر تصدیق ان کے شناختی کارڈ نمبرز کے ساتھ کی جا سکتی ہے ۔ 22۔ اس بات کا مشاہدہ کیا جا سکتا ہے کہ کراچی کا ایک خاص پس منظر ہے جس میں امن عامہ سے متعلق سنجیدہ معاملہ شامل ہے۔ عدالت کے اس سارے معاملے پر مقدمہ بعنوان وطن پارٹی بنام فیڈریشن آف پاکستان میں بھر پور غور و خوض کیا (PLD 2011 SC 997) اس حکمنامہ میں کراچی میں حلقہ بندیوں کیلئے واضح احکامات دئیے گئے تھے جو اسطرح سے ہیں۔ مزید خیال رکھا جائے کہ سیاسی ارتکاز سے بچا جائے۔ اور نسلی و ثقافتی کشمکش اور باہمی جنگ، انتظامی اکائیوں جیسا کہ پولیس اسٹیشن، ریونیو اسٹیٹ وغیر کے زیر اثر حد بندیوں کو تبدیل کیا جانا چاہیے۔ تاکہ مختلف مکاتب فکر سے تعلق رکھنے والے معاشرے کے اراکین امن اور ہم آہنگی کے ساتھ رہ سکیں بجائے اس کے کہ وہ مختلف گروہوں کو یہ دعویٰ کرنے کی اجازت دیں کہ یہ خاص علاقہ ان سے متعلقہ ہے اور کوئی دوسرا خاص علاقہ ان کے تابع نہ ہونے کی وجہ سے ممنوعہ علاقہ ہے۔ اس سب کے بعد یکساں فہم اور متعلقہ قانون کے تحت اس مقصد کیلئے مختلف علاقہ جات کی حد بندیاں بھی کی جائیں تاکہ کراچی جو معاشی و اقتصادی سرگرمیوں کا مرکز ہونے کے ساتھ ساتھ پاکستان کا چہرہ بھی ہے، کو مستقل قریب میں پر امن شہر بنایا جا سکے۔ الیکشن کمیشن آف پاکستان بھی خود ہی اس سارے عمل کا آغاز کرے ۔ ہم یقین سے کہہ سکتے ہیں کہ اب تک مذکورہ بالا ہدایات کا نفاذ نہ کیا گیا ہے اس لئے الیکشن کمیشن آف پاکستان کی ذمہ داری ہے کہ وہ عدالت ہذا کے سامنے وضاحت پیش کرے۔ اس نقطہ پر غور و خوض کی ضرورت نہ ہے کہ آیا مذکورہ بالا ہدایات مذکورہ مقدمہ کے پس منظر میں جاری کیں گئیں تھی اور اس پر دو چند بحث بھی ہوئی تھی۔ مذکورہ حکمنامہ سے ایک اور متعلقہ پیرا یہاں نقل کیا جا رہا ہے۔ 26۔ یہ امر قابل ستائش ہے کہ کراچی میں مقدمہ کی سماعت کے دوران قانون نافذ کرنے والے اداروں نے، ٹارچر سیلز کا سراغ لگایا اور وہ مجرموں کے وحشتناک، خوفناک، ظالمانہ، ہیبت ناک اور غیر انسانی افعال کی ویڈیو ریکارڈنگ حاصل کرنے میں کامیاب ہوئے، جس میں وہ مردوں کے گلے کاٹتے ہوئے اور ان کے جسموں میں سوراخ کرتے ہوئے پائے گئے ہیں۔ لیکن اب یہ اطلاع ہے کہ کراچی کے مختلف حصوں میں اس طرح کے بہت سے سیلز کا سراغ لگایا گیا ہے۔ 27 ۔ جہاں تک زخمی افراد کا تعلق ہے تو کراچی کے متاثرہ علاقوں میں ان کی تعداد بے شمار ہے جہاں مختلف سیاسی جماعتوں نے لسانی بنیادوں پر ہی بالا دست اکثریتی آبادی والے علاقے قائم کیے ہوئے ہیں۔ اس امر پر غور و خوض کیا جانا چاہیے کہ مزکورہ بالا ظالمانہ وحشتناک واقعات کا مقصد کراچی کے شہریوں کو دہشت زدہ کرنا اور سارے معاشرہ کو یرغمال بنانا ہے ۔ 92۔ ایسی طرح کے حالات ملائشیا میں بھی تھے۔ اور حکومت نے مکمل ذمہ داری اورخلوص کا مظاہرہ کرتے ہوئے مجرموں سے تمام غیر قانونی اسلحہ لے لیا۔ اسی طرح ہمارے ملک میں بھی یہ کام کیا جا سکتا ہے اگر قانون نافذ کرنے والے ادارے پوری ایمانداری سے یہ کام سر انجام دیں۔ لیکن موجودہ حالات میں پولیس کو سیاست سے پاک کئے بغیر مثبت نتائج کی توقع ایک مشکل کام لگتا ہے۔ بہرحال کراچی میں امن یقینی بنانے کیلئے کچھ اقدامات ضرور کرنے پڑیں گے۔ قانون نافذ کرنے والے اداروں کو سیاست سے پاک کرنا پڑے گا اور ساتھ ہی ساتھ غیر قانونی اسلحہ کی برآمدگی کیلئے حکومت کو آنے والے پروگرام کے تحت موثر اقدامات کرنے پڑیں گے۔ جہاں تک 2.5 ملین غیر ملکیوں کی کراچی میں موجودگی کا مسئلہ ہے یہ مجرموں کی سرگرمیوں اور ان کے گھناؤنے جرائم میں ملوث ہونے جیسا کہ ٹارگٹ کلنگ وغیرہ سے زیادہ خطرناک ہے۔ مسئلے کا یہ رُخ ظاہر کرتا ہے کہ اس طرح کے لوگوں کی موجودگی نہ صرف جرائم میں اضافہ کا سبب ہے بلکہ ساتھ ہی مناسب رجسٹریشن کے بغیر یہ لوگ ملکی معیشت پر ایک بوجھ ہیں اور ان کی موجودگی بہت سارے انتظامی مسائل کا سبب ہے جن میں قومی شناختی کارڈ کا حصول بھی شامل ہے۔ اگر وہ اس کوشش میں کامیاب ہو گئے ہیں اور اپنے آپ کو پاکستان کا شہری ظاہر کرتے ہیں اور اپنا نام انتخابی فہرستوں میں درج کروا چکے ہیں تو یہ اصل ووٹ دہندگان کو اپنے نمائندوں کے چناؤ سے محروم کرنے کا باعث ہے اور ساتھ ہی ساتھ ان لوگوں کی موجودگی کی وجہ سے جو علاقے میں پھیل گئے ہیں جو کہ حلقوں کی صوبائی اور قومی اسمبلیوں کی حلقہ بندیوں پر براہ راست اثر انداز ہوتی ہے لہٰذا حکومت کو چاہیے کہ ان کے خلاف Foreigner Act کے تحت فوری اقدامات کرے۔ NADRA اور پولیس کو چاہیے کہ ان لوگوں کو باہر نکالنے کے لئے محتاط اقدامات کریں۔ NADRA کے پاس ان لوگوں کا علیحدہ ریکارڈ ہونا چاہیے جو کمپیوٹر فائلز پر مشتمل ہو اور ان کا مناسب اور ٹھوس ثبوت ساتھ ہو۔ NADRA اور پولیس کو چاہیے کہ باہمی تعاون اور مستعد حکمت عملی کے تحت کراچی میں موجود غیر ملکیوں کی نشاندہی کریں اور قانون کے تحت ان کے شناختی کارڈ منسوخ کریں۔ اس کام کیلئے ڈی جی NADRA اور انسپکٹر پولیس خصوصی ٹیمیں تشکیل دیں تاکہ یہ کام اگلے سال کے دوران مکمل کیا جا سکے۔ پھر متعلقہ قوانین کے تحت ہر مقدمہ میں کارروائی کی جائے۔ اس کام کو انتہائی ترجیحی بنیادوں پر کیا جائے۔ 23۔ مندرجہ بالا وجوہات (ہدایات) کی رو سے تمام درخواست گزاروں کے تحفظات کو رد نہیں کیا جا سکتا۔ اس بات کا ذکر کرنا بھی ضروری ہے کہ مندرجہ بالا فیصلہ نافذ العمل ہے کیونکہ اس کے خلاف کوئی نظرثانی کی درخواست دائر نہیں کی گئی۔ اس لیے دیا گیا فیصلہ مضبوط وجوہات پیش کرتا ہے کہ ایسی صورتحال میں جب کہ کراچی میں no go areas تھے پولیس کو سیاست میں الجھا دیا گیا (انسپکٹر جنرل پولیس کے بیان کے مطابق، 30 تا 40 فی صد پرنسپل لاء انفورسنگ ایجنسیز کو سیاست میں الجھا دیا گیا ہے) سیاسی پارٹیوں میں کچھ کو چھوڑ کر عسکری گروہ بنے ہوئے ہیں۔ شہریوں کی جان و مال وغیرہ محفوظ نہیں ہے۔ جیسا کہ درخواست گزارنے دعویٰ کیا کہ انتخابی فہرستوں کی تیاری شفاف طریقے سے نہیں ہوئی، علاوہ ازیں جہاں شہریوں کے جان و مال محفوظ نہیں ووٹ دہندگان اس مقصد کے لئے کیسے الیکشن ڈیپارٹمنٹ کے ساتھ تعاون کر سکتے ہیں تو وہاں بے ضابطگیاں ہونے کے قوی امکانات ہیں۔ 24۔ مندرجہ بالا پسِ منظر کو سامنے رکھتے ہوئے درخواست گزاروں کے فاضل وکیل کی طرف سے مثال دے کر کراچی کی انتخابی فہرستوں میں نشاندہی کی گئی بے قاعدگیوں کا جائزہ الیکشن کمیشن کے موقف کہ کراچی کے شہریوں کی گھر گھر تصدیق نہیں کی گئی کے ساتھ لیا جائے تو اس سے یہ نتیجہ نکلتا ہے کہ کراچی کی انتخابی فہرستیں قابلِ اعتماد نہیں ہیں۔ اور یہ امکان نظر انداز نہیں کیا جا سکتا کہ کراچی کے لوگوں کی ایک بڑی تعداد کو شمار نہیں کیا گیا۔ ایک آزادانہ، منصفانہ اور شفاف انتخابات کے لیے ایک درست انتخابی فہرست کا ہونا لازمی شرط ہے، جو کہ نہ صرف آئین کے تحت ضروری ہے بلکہ شہریوں کا بنیادی حق بھی ہے جس کے متعلق ظاہر ہوتا ہے کہ کراچی کے شہریوں کی حد تک سمجھوتہ کر لیا گیا ہے۔ 25۔ یہاں اس بات کا ذکر کرنا غیر ضروری نہیں ہے کہ عدالتِ ہذانے ورکرز پارٹی پاکستان کے مقدمہ کا فیصلہ کرتے ہوئے انتخابی فہرست کی تیار کی اہمیت کو اجاگر کیا ہے تاکہ آزادانہ اور منصفانہ انتخابات کے انعقاد کو یقینی بنایا جا سکے۔ اور مندرجہ ذیل بیان کیا جاتا ہے:۔۔ 67۔ جمہوریت کے استحکام کے لئے منصفانہ، آزادانہ اور شفاف انتخابات لازمی شرط ہے، اس مقصد کے حصول کے لیے الیکشن کمیشن کو قابل اعتماد اور آزاد ذرائع کے ذریعے فوری طور پر انتخابی فہرستوں کی درست تیاری کرنا ہے۔ اس عمل کے دوران صرف نادرا اور اس طرح کے دوسرے محکموں پر، روائتی طور طریقے سے انحصار کو فوری ختم کیا جائے۔ چنانچہ ہم الیکشن کمیشن کو ہدایت کرتے ہیں کہ گھر گھر ووٹ دہندگان کی فہرست کی پڑتال کرے اور اگر ضرورت پڑے تو مسلح افواج اور فرنٹیئر کارپ کی مدد سے انتخابی فہرستوں کی نظر ثانی اور تصحیح کا عمل کیا جائے۔ 26۔ یہ قابلِ غور ہے کہ آئین کا آرٹیکل 219 جو کہ ایک رائج شق ہے بتاتا ہے کہ ووٹر لسٹوں کے قانون بشمول انتخابی فہرستوں کا قانون مجریہ 1974 ء اور اس سلسلہ میں بنائے گئے قواعد کے تحت سالانہ بنیادوں پر نظر ثانی کی جائے۔ یہ صورتحال تسلیم شدہ ہے کہ ووٹر لسٹوں کی نظر ثانی کا معاملہ عدالتِ ہذا کو سیکرٹری الیکشن نے بتایا حکم مورخہ 4-7-2011 کا متعلقہ حصہ درج ذیل ہے:۔۔ جناب اشتیاق احمد، سیکرٹری الیکشن کمیشن آف پاکستان نے بیان کیا کہ:۔۔ (i) نادرا کی رپورٹ کے مطابق درج ذیل اقسام کے غیر تصدیق شدہ ووٹرز کو نادرا کے ڈیٹا بیش سے ختم کر دیا گیا ہے:۔۔ غیر تصدیق شدہ ووٹرز کی اقسام ووٹرز کی تعداد ووٹرز بغیر کسی شناختی نمبر کے 15,028,808 غلط شناختی کارڈ والے ووٹرز 2,140,015 دوہرے شناختی کارڈ کے اندارج والے ووٹرز 2,491,090 دوہرے MNIC کے اندراج والے ووٹرز 6,469,310 ووٹرز جن کا MNIC نادرا میں رجسٹر نہ ہے 11,056,775 کل غیر تصدیق شدہ ووٹرز 37,185,998 (ii) مندرجہ بالا حذف کردہ ووٹرز کی جگہ پر 36 ملین ووٹرز کا ڈیٹا بیس میں اندراج کیا گیا اور جس کی تصدیق الیکشن کمیشن کے نمائندہ کے ذریعے ہر ووٹر کے گھر گھر جا کر کی جائے گی۔ یہ مشق 18 جولائی 2011 ء سے شروع ہو گی اور 16 اگست 2011 ء تک مکمل ہو جائے گی۔ اس نے مزید اضافہ کیا کہ ان فہرستوں کو شائع کرنے اور چسپاں کرنے کا طریقہ کار قانون کے مطابق اپنایا جائے گا اور اس سلسلہ میں ایک جامع منصوبہ مرتب کیا گیا ہے جس کی کاپی ریکارڈ میں رکھ دی گئی۔ اس کے مطابق یہ سارا عمل 16 دسمبر 2011 ء تک مکمل ہو جائے گا۔ اور اس کے بعد یہ فہرستیں جائزے اور اشاعت کے لئے نادرا کے حوالہ کر دی جائے گی۔ یہ عمل سال 2011 ء کے مئی کے مہینہ میں مکمل کیا گیا لیکن حتمی مراسلہ مئی 2012 ء میں جاری کیا جا چکا ہے۔ اب ہمیں سالانہ کی معنی جاننا ہوں گے، جسکا مطلب ہو سکتا ہے، ایک سال بعد یا ایک سال کے دوران، وقتاً فوقتاً، حوالے کے لیے سالانہ کی معنی اور تعریف نیچے دی گئی ہے۔ معنی سالانہ اور تعریف:۔۔ The World Book Dictionary, Volume One 1۔ سال میں صرف ایک دفعہ آنا یا ہونا، آپ کا جنم دن ایک سالانہ تقریب ہے۔ 2۔ ایک سال میں ایک سال کے لیے، اس کی سالانہ تنخواہ Government of Pakistan (PLD 1989 Karachi 123) مقدمے میں یہ طے پایا گیا کہ آرٹیکل 218 کے مطالعے سے یہ بات واضح ہوتی ہے کہ شقات (1) اور (2) کمیشن کی تشکیل و ترتیب مہیا کرتی ہے جبکہ شق 3 اس کے فرائض کے بارے میں بتاتا ہے، جیسا کہ انتخابات کے حوالے سے الیکشن کمیشن کا فرض ہو گا کہ وہ انتخابات منعقد کروائے اور ایسے انتظامات کرے جو صاف شفاف اور قانون کے مطابق انتخابات منعقد کرانے کی یقین دہانی کے لئے ضروری ہوں اور بد عنوانی کے خلاف حفاظت فراہم کرے، جبکہ آرٹیکل 219 کمیشن کے اُن فرائض کے بارے میں بتاتا ہے جیسا کہ قومی اور صوبائی اسمبلیوں کے لئے انتخابی فہرستوں کی تیاری اور سالانہ اُن فہرستوں کی نظرثانی کرنا، سینٹ کے انتخابات منعقدکروانا، قومی اور صوبائی اسمبلیوں میں عارضی آسامیوں کو پُر کرنا اور الیکشن ٹربیونلز کا تقرر کرنا۔ اس حقیقت کو نظر انداز نہیں کیا جا سکتا کہ آزادانہ، منصفانہ اور صاف شفاف انتخابات ہمارے جمہوری نظام کے روح رواں ہیں۔ ایسے انتخابات نہ صرف صاف شفاف اور منصفانہ طور پر منعقد کروانا چاہئیں بلکہ ایسا نظر بھی آنا چاہیے تاکہ رائے دہندگان کا اعتماد حاصل کیا جا سکے۔ آئین کے آرٹیکل 219 کی شقوں، انتخابی فہرستوں کا قانون مجریہ، 1974 اور اس کے تحت بنائے گئے قوانین کی تشریح ضروری طور پر اس طرح کی جائے کہ مندرجہ بالا مقاصد حاصل ہوں۔ نتیجتاً، الیکشن کمیشن کو آئین کے آرٹیکل 218 کے تحت اپنے فرائض کی انجام دہی کرنی چاہیے جیسا کہ آزادانہ، منصفانہ اور صاف شفاف انتخابات کو منعقد کرانے کی یقین دہانی اور اس مقصد کے حصول کے لئے وفاق کے انتظامی اداروں سے معاونت طلب کرنا، جو کہ آئین کے آرٹیکل 220 کے تحت مہیا کرنا انتظامی اداروں کا فرض بنتا ہے۔ 27۔ اس حقیقت سے انحراف نہیں کیا جا سکتا کہ، آزاد، بے داغ، منصفانہ، صاف و شفاف انتخابات الیکشن آج کی ضرورت ہیں کیونکہ ملک کا پارلیمانی نظام روز بروز مستحکم ہوتا جا رہا ہے۔ اس لئے سبھی اہل شہریوں کو حقِ رائے دہی کا بنیادی حق حاصل ہے جس کو ضروری ہدایات جاری کرتے ہوئے تحفظ فراہم کیا جائے۔ 28۔ متذکرہ بالا حالات کی روشنی میں یہ ثابت ہے کہ کراچی شہر کی انتخابی فہرستوں کی نظر ثانی الیکشن کمیشن کی جانب سے ضروری ہے اور الیکشن کمیشن آف پاکستان کو آئین کے آرٹیکل 219 اور انتخابی فہرستوں کے قانون مجریہ 1974 کے تحت حاصل کردہ اختیارات کے تحت یہ کارروائی عمل میں لانی چاہیے جو کہ آئین کے آرٹیکل 218 کے تحت کمیشن کے لئے لازم ہے لہٰذا الیکشن کمیشن آف پاکستان کو ہدایات جاری کی جاتی ہیں کہ وہ کراچی میں جائز اور درست طور پر ووٹرز کے اندراجات کی تصدیق گھر گھر جا کر کروائے تاکہ یہ یقینی بنائے جائے کہ کسی ووٹر کا اندراج فہرستوں میں رہ نہ جائے اور کوئی شخص اپنے حقِ رائے دہی سے محروم نہ رہ جائے اور موجودہ فہرستوں میں تمام خامیوں کو دور کیا جا سکے۔ کراچی شہر کی بگڑی ہوئی امن و امان کی صورت حال جو کہ پہلے زیر بحث آ چکی ہے کو نظر میں رکھتے ہوئے الیکشن کمیشن انتخابی فہرست کی تصدیق کے لئے پاکستان آرمی اور ایف سی سے مدد حاصل کرے۔ 29۔ مندرجہ بالا وجوہات کی روشنی میں آئینی درخواست نمبر 45/2007 اور 111, 123/2012 کو نمٹایا جاتا ہے اور آئینی درخواست نمبر 31/2011 غیر معینہ مدت کے لئے ملتوی کی جاتی ہے۔ MWA/I-9/S Order accordingly
